My only point is the Third Amendment has never been recognized by the courts as a basis for damages. I understand the analogy to the function of troops in Colonial America where police forces as we know them today didn't exist.

I just don't think a judge would risk reversal on a new legal theory where well-established legal theories should give this family relief.

Since our police are no longer police, but a militarized occupation force, I think the 3rd argument is going to become relevant.

Police were once police. Now they are the strong arm of the fedgov.
