Once the EO decision went to court there wasn't much more he could do.
That being said, my impression is that he's waiting for the court decision. And did you know the federal judge hearing the case early last week voiced skepticism about Holder's position?

If that were the only issue, I would agree. When even Gretta was taking him to task on subpoenas, he just snickered in her face. She shot back incredulous with his disrespect and the smile left his face and then tried to change the subject. I have not seen him there since.
