Despite potential budget cuts being 4 days away and Congress and the Administration have been negotiating to avoid them, the Department of Homeland Security has already started releasing hundreds of illegal aliens held in local jails in anticipation of automatic "sequestration" cuts - out of a planned total of more than 10,000 aliens to be released.
Sources tell Stand With Arizona that DHS has "34,000 beds" for illegal aliens, meaning that Secretary Janet Napolitano is releasing nearly 1/3 of all DHS-detained illegal aliens in the United States - despite the fact that no actual cuts have even begun, and despite a record of massive wasteful spending by DHS over the past 3 years.
Napolitano had been warning of potential impact to DHS after impending cuts, but now she has jumped the gun by enacting a "budgetary amnesty" by fiat - releasing thousands of criminal aliens amongst communities and families across the nation.
The New York Times reports that the aliens are being "freed on supervised release while their cases continue in court". But as SWA has reported in the past, many aliens facing deportation or prosecution on immigration holds never show up for those hearings, and remain in the country.
One Arizona Sheriff called the DHS action politically motivated -- and dangerous.
Pinal County Sheriff Paul Babeu said Tuesday that Immigration and Customs Enforcement released more than 500 detainees in his county alone over the weekend. ICE officials told Babeu that they plan to release a total of nearly 10,000 illegal aliens.
Babeu described the move as a "mass budget pardon" and suggested the administration was going to unnecessary lengths to demonstrate the impact of the so-called sequester.
"President Obama would never release 500 criminal illegals to the streets of his hometown, yet he has no problem with releasing them in Arizona. The safety of the public is threatened and the rule of law discarded as a political tactic in this sequester battle," he said.An ICE official confirmed the plans without specifying how many illegal aliens might be released.
Spokeswoman Gillian Christensen said ICE had directed field offices to make sure the "detained population" is "in line with available funding." She stressed that ICE would continue to prosecute the cases while keeping them "under supervision".
The announcement comes after DHS Secretary Janet Napolitano on Monday warned about the potential impact of the cuts. She said the department "would not be able to maintain the detention beds as required by Congress."
"We're doing our very best to minimize the impacts of sequester. But there's only so much I can do," she said. "I'm supposed to have (thousands of) detention beds for immigration. How do I pay for those?"
House Judiciary Committee Chairman Bob Goodlatte, R-Va., called the move to release illegal immigrants "abhorrent."
"By releasing criminal immigrants onto the streets, the administration is needlessly endangering American lives," he said in a statement.
In Arizona, Babeu slammed the move, painting his community as a victim of gridlock in Washington.
"Clearly, serious criminals are being released to the streets of our local communities by this mass budget pardon. This is insane that public safety is sacrificed when it should be the budget priority that's safeguarded," he said.
As Arizona, and other states brace for the impact of this disgraceful and lawless action, we call on Sheriffs across America to defy this corrupt DHS Secretary, and detain as many illegal aliens as possible. We know that Sheriff Joe and his deputies are on high alert today as these alien criminals are being set loose in our communities.
Just when you think the shameful pandering and legal anarchy of this Administration can't get any worse, it does...in spades.

What should have been done at the time or announcing the release was:
DHS will pay a bounty of $50,000 for any and all illegal aliens killed while committing a felony.
Illegal aliens do not have to remain a drain on the economy. They could easily be transformed into a harvestable resource.
Congress will not do that, no matter what. It creates accountability. Plus, consider that Obama has already issued an executive order that effectively grants amnesty to those in the country illegally. If that wasn't enough to raise an eyebrow, then turning a few loose won't raise an eyebrow either.
Serves two purposes:
1. Another form of amnesty
2.An effective way of demagoguing the entire bogus
“sequester” issue,while getting ready to crow about their “foresight”
in being able to anticipate the vote yet to come.
Whatever havoc is loosed by the illegal aliens being freed
will of course be the Republican’s fault.
The Dems have as usual positioned themselves to be in a

Pinal County, Ariz – Sheriff Paul Babeu blasted the Washington gridlock regarding the “Sequester Budget Battle” and says it is already harming public safety in Arizona by ICE’s mass release of hundreds of illegals and plans for the release of nearly 10,000 more criminal illegals from prison.
Many of these ICE detainees are held at private facilities, which are contracted to house criminal illegals. ICE reportedly plans to reduce their available beds to 25,700 from their current 34,000. Sheriff Babeu said, “Clearly, serious criminals are being released to the streets of our local communities by this mass budget pardon. These are illegals that even President Obama wants to deport. This is insane that public safety is sacrificed when it should be the budget priority that’s safeguarded.”
ICE agents were paid overtime Saturday and Sunday to release over 500 detainees in Pinal County alone. These criminal illegals were scheduled for deportation, yet now they receive a pardon and once again become the problem of local law enforcement and a burden to the state of Arizona. The President predicts a doomsday scenario and his plans are already being implemented.
Sheriff Babeu concluded, “President Obama would never release 500 criminal illegals to the streets of his home town, yet he has no problem with releasing them in Arizona. The safety of the public is threatened and the rule of law discarded as a political tactic in this Sequester Battle.”

It’s a budget FREEZE. The budget(s) will remain at their current levels.

This is the left sending a warning shot across conservative’s bow. They are saying, “If you don’t pay up, we will punish you.” This is also your government no longer serving you and the law but showing you who is in power now. This is medievel; a replay of life in Europe in the 1200’s.

Most of them are being released on their own recognizance (OREC)to report in to their new location in about two to three weeks. After that they will not be being supervised beyond needing to keep their mailing address up to date with the immigration court they are now assigned to. Some may skip town. If they don't it is likely that their cases would drag on for another year or two. By that time Obama will have freed them on to a path to citizenship anyway.
This will not change even if some kind of deal is reached in the near, medium or long term. This is how it will be done from now on with those convicted of minor offenses, (shoplifting, simple DUI, misc. traffic offenses beyond being here illegally.
This week De Facto legalization/regularization went into high gear. It will remain there. Call it “Catch & Release”.

Obama will make damn sure that his sequestration threats become reality. Napoltano is a prime example, he has his people in government positions to create chaos. Obama has some very dangerous personality disorders, and now we can include passive-aggressive to the list. He should not have “the code.”

The threat that we heard at the airport on our way home from Arizona was that they'd furlough half the TSA employees working the security checkpoints. So instead of eight lines of travelers taking their shoes and belts off to get through airport security, there will be four lines ... twice as long.
This illegal alien "catch and release" program by Janet is consistent with the plan to make the sequester hurt voters.
If we had a Congress with half a ball sack we might have a legislative body that would push back on this. But, sadly, all we have is a hall full of eunuchs.
Who is going to do something about it? The people who confirmed Hagel?

Well, maybe...you have to remember under the rules, especially recently it takes a lot just to get an illegal detained to begin with.
