But we're still stuck with the Raich precedent, about which Thomas concluded in his dissent - "the Federal Government is no longer one of limited and enumerated powers." At best, the so-called Commerce Clause 'victory' means that the line was not expanded beyond Raich. Everything in Obamacare - except the mandate - is allowed under current Commerce Clause case law. It's about the hollowest victory I can imagine.
Perhaps we can all conclude that it is not possible to defeat obozocare in court -
had Roberts ruled it unconstitutional, do you honestly think it will matter? The Commerce Clause was not touched at all. Mark Levin clearly explained in great detail why the Commerce Clause was not effected in any way.
