Lamberth hinted at the controversial decision when he asked Roberts if it bothered him that he can’t respond to his critics.

“No,” Roberts said, his brief answer hanging in the air to more laughter.

Equal justice under the law comes from the 14th amendment which was to protect individual rights at the federal level, and limited the states'. The Constitution is made up of more than the 14th amendment, but he specifically brings up this one point. Interesting.
