Also, Edge, I was on the birther side back then but I read other FReepers comments that caused me to REALLY look into it that ultimately led me to doubt the NBC clause in a Vattel sense. You might say I went to the dark side but until legal authorities state otherwise, I’ll obey the law. In other words, I am not convinced that our president requires citizen parents. Born in the USA rules with this Jersey boy!

If you doubt the Vatel definition then what do you think is the distinction between being a citizne to be in congress
and being a NBC to be POTUS??
Why are there 2 different sets of qualifications ?

There isn’t a “birther” side of this issue, the real law. The Supreme Court cited Minor as the primary precedent on presidential elgibility. Since Minor rejected an argument of citizenship based on the 14th amendment, they effectively rejected any notion that NBC can be defined only on the basis of the place of birth. Otherwise, they should have accepted Minor’s argument, but they didn’t. What other reason would there be for talking about the citizenship of the parents in defining someone’s citizenship, if not for how it exclusively defines NBC??
