Many hotels will be shutting down their pools until they can afford to install the robotic limb.”

In fact many small boutique hotels and probably most motels and hotels will be forced to shut down their pools permanently.

Only larger facilities where a pool provides a competitive advantage will bother with the expense.

Will those who get hurt tripping on or over these stupid mechanical hosts get to sue the hotel or motel forced to install them? A litigant's dream come true thanks to the evil Obama empire.

I’m thinking a damned wheelchair ramp is plenty.

It will mainly be poor minorities in the south that will feel this kind of heat from the administration.

My guess is that Obama will issue an EO exempting pools that have a majority of "protected class" clientele.

UnConstitutional on its face as it exceeds the FEDGOVs authority.

This is just the camel’s nose under the tent.

Next, it will be a requirement for all private backyard pools too. Then, all bathtubs and rivers and lakes will incur the regulations too.

Follow the trail of the anti-smoking regulations from their start to the total mess they are today. Step by step...every year...the regulations grow.

Where the hell does it stop? When will the bleeding hearts realize that handicaps can limit what people can do and it is not up to the public to pander to them. It’s out of control...like the blind man who climbed Mt. Everest.

If you believe he did that all by himself, I’ve got a hell of a good deal on gold for you.

I just received the new yearly tax statement on one of my houses and the “old” house that I bought for $20,000 back in 2000 is now suddenly valued at $93,000 by the stroke of the pen of the unqualified tax assessor. Why? Simple; the huge wast of money by the school district (including ADA compliance) and the city’s cost of ADA compliance and modifications to meed current specifications. Also in the mix is paying for trial lawyers to settle ADA cases and individual discrimination lawsuits by the “disabled.”

I am old and would like to young again. I guess I could sue God for making me old or better yet, force him to make me look young again through some type of ridiculous regulation.

The problem is that they can do this with a ‘regulation’ change. Big Problem

Now the hotel has made the pool accessible to handicapped people who otherwise would not have been able to get into the water.

Do they also have to provide a lifeguard to ensure the handicapped person doesn’t drown?

I agree that this shouldn’t be mandated but the robotic arm is a simple and can’t be all that expensive item. I’ve seen it lift a paraplegic vet into the water. This is the same guy who when in his wheelchair, insisted once on opening the door for me at the gym. He gets into the pool and swims twenty laps.

I defy anyone to name ONE thing the “goverment” does not have their over-reaching hands in! Name just ONE.
The air you breath.
Where you may walk.
How you travel.
What you may eat.
What kind of pet you may have.
But you can “marry” whatever you like.

I’ve never seen this device, but now I’m wondering... How many of our little water lizards are going to be hurt by playing with this elevator? We all know how “attentive” the parents of “other peoples’ kids” are.

About the only thing that could top this would be the Obama regime, in its pursuit of more gay marriage, mandating that at least one partner to a pairing be outfitted with the means to provide vaginal birth.

We’ve got one of these in the pool at the city rec center where I swim. It effectively blocks on of the swimming lanes...and nobody ever uses it.

RE :”The Obama Administration has recently construed the Americans with Disabilities Act (ADA) and Standards for Accessible Design to apply to the act of swimming.
Today, this regulation was supposed to go into effect, opening up the owners to $100,000 fines as well as trial lawyer liability. However, thanks to the kindness of the Justice Department, existing pools now have until January 2013 to comply. “Newly constructed or altered places of public accommodation, commercial facilities and state and local government facilities” operating swimming pools will now be required to install permanent structures that lower physically disabled patrons into the pool. These establishments may also be forced to remove “accessibility barriers.”
The premise of this entire concept — allowing bureaucrats in DC to tell Americans how to run their swimming pools is more outrageous than the overly scandalous title to this article. Purchase and operation of these mechanical arms or “elevators” that lower people into the pool cost northward of $10k.

This is typical.

Bush Sr pushed this piece of crap Federal law ADA and liberal Martha supposedly was pushing him on it.

This type of dangerous and destructive law uses the words ‘reasonable accommodations’ which allows any administration to come in and bankrupt not just businesses but local governments.

I have long noticed bathrooms with limited space that are required to use it all for a single stall.
Or the $500 fines for parking in a handicapped parking spot, yet the police never spend the time to stake out these spots so non-handicapped relatives can and do just use the parking decals for their own parking without a threat.

It really won’t matter anymore. When O gets re-elected, all the disabled will be killed off. Then we won’t have to worry about spending money on ramps, and lifts and crap like that.

Compliance may be a bit difficult down at the old rock quarry.

15.8.2* Swimming Pools. At least TWO accessible means of entry shall be provided for each public use and common use swimming pool...

http://www.access-board.gov/adaag/html/adaag.htm#15.8 Swimming Pools, Wading Pools, and Spas

A15.8.5.7 Operation. Pool lifts must be capable of unassisted operation from both the deck and water levels. This will permit a person to call the pool lift when the pool lift is in the opposite position. It is extremely important for a person who is swimming alone to be able to call the pool lift when it is in the up position so he or she will not be stranded in the water for extended periods of time awaiting assistance. The requirement for a pool lift to be independently operable does not preclude assistance from being provided.

A15.8.6.1 Sloped Entries. Personal wheelchairs and mobility devices may not be appropriate for submerging in water. Some may have batteries, motors, and electrical systems that when submerged in water may cause damage to the personal mobility device or wheelchair or may contaminate the pool water. Providing an aquatic wheelchair made of non-corrosive materials and designed for access into the water will protect the water from contamination and avoid damage to personal wheelchairs or other mobility aids.

I saw one of these abominations newly installed in a relatively new Marriott hotel (brand and location intentionally not mentioned) last week. I stood and stared at the contraption. I am an electrical engineer and I examined the device pretty closely. I decided not to go into the pool because if the pool was full and there were enough people in the pool it might be possible for water to enter the sealed junction box on the “arm of death”. If the gasket leaks, look for people in the pool dying to satisfy this new mandate for the disabled.

I wonder who is making a fortune off this mandate?
