I believe no one can ‘recuse’ a party except the party, in this case, Kagen herself. Justice Roberts cannot recuse her. Elena Kagan is on the court for just this purpose and spineless people let her be appointed because of her race and the fall out from not being allowed on the court. Never ever vote for a person because of the color of their skin, black, white, yellow, red, or purple.

It could still come to pass that she does recuse from deliberations and voting towards the court’s final opinion.
I also see the likelihood of that being none to slim, in that order.
Roberts should have forced her to recuse or removed her from the case. Obvious conflicts of interest. You can’t argue FOR something as its defender (solicitor general of the US) and then be a Justice on the SCOTUS and have anyone believe you could impartially rule AGAINST what you previously argued FOR.
Impossible for honest rational person to not admit.
Kagan replaced another liberal vote, another sure thing. No big deal. It would be nice if she gone, but if she recused herself, the commie pinkos would scream for Thomas to recuse himself, based on something his wife did.
However it goes, this is going to be a 5-4 decision. The only guy who really counts now is Kennedy.
I wonder what the consequences will be if Obama Care doesn’t pass the test? All that wasted time, instead of trying to generate new jobs.....create an energy policy.....or just work on what we had. Sounds like a whole lot of nothing got done.
