Police Commissioner’s son Greg Kelly will not be charged with rape by Manhattan prosecutors

Accuser had said she was raped after boozy night

EXCLUSIVE: Manhattan prosecutors cleared TV anchor Greg Kelly of rape, the Daily News has learned.

“We have concluded that the established facts do not constitute a crime under New York criminal law,” said Joan Vollero, spokeswoman for Manhattan District Attorney Cyrus Vance, Jr.

News of the prosecutor's decision was first reported on NYDailyNews.com.

ANALYSIS: KELLY STILL HAS A FUTURE IN TV

A 28-year-old paralegal had accused the “The Good Day New York” host and son of NYPD Commissioner Ray Kelly of raping her in October after a boozy night at a dive bar.

But after reviewing receipts, security logs, text messages, and telephone records, investigators concluded a crime had not occurred, sex crime unit chief Martha Bashford told Kelly’s criminal lawyer, Andrew Lankler.

“They are not pressing charges,” he told the News after meeting with Bashford Tuesday.

Kelly’s accuser went to police on Jan. 24 with the rape allegation, saying she had to terminate a pregnancy after the encounter, according to sources.

She said she and Kelly went out for drinks and she took him to the law offices where she worked, where she said he raped her.

The accusation was problematic, not just because three months had passed, but because the woman had sent Kelly flirtatious friendly messages both before and after the encounter.

Because Kelly’s father runs the department, the NYPD immediately handed the case to Vance’s office.

The investigation took two weeks and included interviews with both the accuser and Kelly, both of whom Vance’s office called “cooperative.”

Another follow-up, and apparently a resolution, to these stories:

AP source: NYPD head's son accused of sex assault

and

Kelly and accuser exchanged messages before, after alleged rape,

the earlier of which broke on the same day as two other stories critical of Greg's father, Ray Kelly, arising out of NYPD/Muslim relations.

Rape has empowered women to use it as a tool against men in an attempt to “get rich quick”.

I am not saying that rape is not an issue nor a problem, but like racism, it is over-used

Most rape accusations end this way.

What I thought was particularly noteworthy about this story was the fact that the accuser came forward just two days before CAIR and other Muslim agitators demanded the resignation of Greg Kelly’s father, Ray, over his handling of a couple of islamoterrorist matters, even though the events giving rise to the rape charge occurred more than three months earlier.

I suppose we’ll never know the name of the accuser, or her boyfriend who instigated the accusation, but it would be interesting to know if either is Muslim.

"Isn’t that FOX New’s Megan Kelly’s husband?"

No relation. Greg Kelly is a Marine vet, worked for Fox News and was embedded with a unit during the early days of the Iraq War.

Rape is a horrible crime

Lying about rape is an even worse crime.

A, engaged to B, meet C in a bar. A and C go to A's office and have sex. A turns up pregnant and B knows he always uses a condom. A claims she's been raped and, for some reason never mentioned it before. A gets an abortion and prefers rape charges against C.

Is that about it?

When a woman cries “rape!” after a night of booze and there is no evidence of physical coercion, I have no sympathy at all with the woman and I cannot see where there has been a rape. It is a woman thinking in the morning that she “shouldn’t have done that” and then charging rape. That rape charge is then simply CYA or to make herself feel virtuous.
