Shaun Day made the mistake of running a red at 12:30 a.m. in the city that never sleeps. When pulled over by the cops, they found a 9mm and three mags in his truck. Day told the cops he was a Navy SEAL but didn’t have any proof. As a result, he spent a day in Bellevue under psychiatric care. Until, that is, the Navy sent people to confirm he actually is a SEAL and got him the hell out of there. . .
According to nypost.com he was rambling incoherently during the traffic stop. Translation: he told the cops he was a SEAL, they didn’t believe him, figured he’s just a coked up wacko and dumped him at Bellevue. Charges against Day have been “deferred.” Translation: New York’s had enough bad publicity concerning their laughably restrictive firearms laws in the last month and they’d rather not charge an active duty SEAL with possession and suffer even more embarrassment. Look for the case to be quietly dropped.

Sorry, but if he ran a light, was acting loopy, had a stash of guns, and it doesn’t sound like much ID then he doesn’t have a leg to stand on. SEAL or not. How does being a SEAL make him above the law?
I tend to agree with you. Not sure how you would prove you were a SEAL anyway. I can see proving your are Active Duty with an ID card...but what...going to show them your tatoo or something?
Bottom line, he was on vacation (leave), he broke the law, had a gun with him, and obviously provoked the cops into searching his vehicle which landed him into the mess. It is not typical to get your vehicle searched for just running a red light. So either he had his weapon in plain view or he pissed off the cop.
These guys when they come back from intense operations do have a tendency to have anger control issues. A 45 year old friend who is a National Guard/School Teacher who spent a year in Iraq on IED patrols and road patrol, struggled mightily with flashes of anger, road rage, frustration, etc. the first year back. Call it PTSD or whatever, they operate under HIGH stress for long periods of time and it does take them time to decompress and return to normal.

UCMJ. Look it up. If he was ordered to carry there is nothing a State law can do about it.
I know he can carry however show me the law saying he’s free to run red lights or to act like he’s under the influence with a cop. Again, it doesn’t seem as if he was carrying appropriate ID.
A major constitutional problem with New York’s gun laws is that their is no way a non-citizen can get a permit to carry in NYC, whereas is theoretically possible(not likely, but possible) for a resident to obtain a permit to carry. Thus, you have an unequal treatment under the law. Moreover, it is possible, legally, for a NYC resident to carry, but not a non-resident. So much for the right to keep and bear arms. At any rate, the unequal treatment under the law, is all thats needed to get their laws thrown out by an appeals court. I am frankly, surprised that Plexico Buress didn’t try to fight his conviction in such a manner. Though, anyone who carries a Glock with a round chambered and not even a SERPA holster, deserves jail time for reckless stupidity.
