Reader's viewpoint - For two years, the police have kept my gun(OH)

I live in Uhrichsville. Within eight months’ time, my property was broken into three times.

After the second time, I had a security system installed.

At 2 a.m. on April 24, 2010, the alarm to the backyard barn went off. I armed myself and went to check it out. The barn door was wide open and a man was inside looking around with a flashlight. I yelled at him to come to me and he came at me with a tire iron in hand. He was less than 10 feet away when I fired a warning shot. He turned and ran; I fired more shots trying to get him to stop. At no time was I trying to hit him.

The police came, took the tire iron that he dropped and also took my gun. It’s been almost two years, and I still cannot get my gun back.

No charges were ever filed. I saw a lawyer and was told it would cost me $400 to file papers with the court for return of the gun.

The gun was registered and I have a permit to carry. I’m 68, never been in trouble. I fired in self-defense. Why are they keeping my gun?

Recently in New Philadelphia, a man fired three shots at a truck in town. The police took his gun and returned it the same day with a warning. What is going on in Uhrichsville?

Can someone please help me get my gun back?

You are so incredibly dense. For the millionth time, (for you slow types) what is more dangerous, a shot in the air or a shot at a perp with a bunch of innocent people behind him? How dense can you be? Yes, a shot in the air MIGHT strike an innocent, but (NEWS FLASH, GENIUS!) a shot at a perp with a bunch of innocent people behind him MIGHT strike an innocent person behind him! See how that works? Probably not.
BTW, macho has EVERYTHING to do with it. NOTHING is more macho than “Double tap to center mass, followed by one to the head!” Psuedo tough guys LOVE talking that way. Beats the hell out of talking about warning shots.

That’s the question and it’s a tough one. I don’t think there is a one size fits all yes or no answer. I think it depends on the circumstances including but not limited to the tactical situation, the legal situation, and the mindset of the shooter.

I think it’s dangerous to look at your own corner of the Universe and assume “What’s good here for me must be good everywhere for everyone.” That might be true, but it’s dangerous to just assume it.

I would find a reporter who is “conservative”,.... I know what you all are thinking, and get them on this story. The polcie dont want the negative publicity especially if you are in a rural area.

Seems like treble damages plus maybe “punitive” would apply since they violated your “civil rights”

If there is no need for deadly force then you have no business clearing the holster. That’s why the concept of ‘warning shot’ is ludicrous, hypothetical or not.

Over the past several decades I've cleared the holster several times when there only might be a need for deadly force. I don't mean doing so when I was out and about, although I'm not in principle opposed to doing so, as unseen as possible. However I have done so when answering the door late at night or when checking something in the yard late at night. And on the occasions when I have taken it, I don't even have a holster for the shotgun.

I am not the hero of a "B" Western nor do I play one on TV. I don't claim to be able to let the villains go for their guns first and reliably beat them to the draw like in the movies.

The 11th Rule of Gun Fighting: "Always cheat; always win. The only unfair fight is the one you lose."

Because warning shots go places dipstick. You were in raghead land, celebratory sky shots killed diaperheads. Those slugs land somewhere-—roofs and skulls.
