The real danger starts after you pull the trigger. Hopefully, the DA will have a better view of the situation but there are no guarantees. Prayers up for a good outcome for Christopher.
Needs a good lawyer.
No offense to your friend, but after reading the article.....sounds like far more to this story.
This was not in the news story. How do you know this, and can you expand on this?
The article says they were residents of the same apartment complex. What was the fight about?
The article doesn’t make the circumstances clear enough to draw a conclusion of either self defense or laying in wait for an expected attack. I’ll take your word on his character and offer prayers.
The link for KOSA appears to be down, for those who are looking for it.
The story is on Google News, but links are not working.
Prayers here.
He’s been charged with first degree murder. Sounds like some witnesses are telling a different story than the defendant. Bottom line: If he felt his life was in danger he can use deadly force. This is Texas!
Wow! This is from my home town. Hope all goes well for your friend. Prayers for all
I’ve read more than a few threads on FR that when these things happen and the cops show up; all you are to say is “I was in fear for my life and I want a lawyer”.
Cops keep asking questions; you keep saying...
“I was in fear for my life and I want a lawyer”.
Now this man is being charged with 1st degree murder, and there are witnesses?
Yes he does need prayer. And a real good defense attorney.
Some states define it as "willful and premeditated", others "malice aforethought." Wonder if that is enough to be a capital crime in Texas?
Mr. Simms looks much too skinny to be straight. Does he use drugs? Both his body habitius and his facial expression scream meth, or crack cocaine. Has he had a substance abuse problem in the past?
Nevertheless, I will pray for his soul. I know that ‘the devil’s prowling around like a roaring lion devouring those he may’ God help him and comfort the families of the victims. Amen
No, you say nothing more than '(he/they) were trying to kill me. I think I'm (having a heart attack/wounded), please call an ambulance!'
... and then you lay down and close your eyes and breathe slowly until they scoop you up and admit you to the hospital for undiagnosed chest pains/angina. You call your lawyer from the hospital room.
Instantly, the officer's duty becomes to protect the living, meaning you. This is also the best idea because you cannot be entirely certain that you are not wounded. There's been many documented cases where people fended off attacks and no authorities at the scene knew that the victim was wounded until they collapsed or someone realized that the red garments the victim was wearing was actually clothes or shoes sopping wet with blood.
And these days, at my age, I think I'd go to the hospital for an examination even after a minor automobile collision. Wouldn't you? And after a self-defense action, *doubtlessly*, right?
After a self-defense shooting, you have three choices:
1. Flee to Bolivia.
2. Go down to the police station to get grilled by the cops.
3. Go to the hospital emergency room where the cops aren't allowed to hover over you asking questions and you're allowed to talk to your lawyer in peace.
You tell me which is the most preferable.
These are the things that you learn in GOOD self-defense courses that have retained legal minds to help guide the program's curriculum.
neat ideas there....
