Obama put Walpin on administrative leave and therefore did not fire, fire him. It depends on the definition of what ADMINISTRATIVE LEAVE AND FIRED is. As the law said no one could act to defend Walpin unless he was FIRED. Yet he cannot (could not) work and no longer has an office. No more slick lawyers as POTUS much less a traitor one.
