I asked the OIP whether the HDOH response was correct. I was told that the OIP lets the HDOH decide what the laws and rules mean. So much for the OIP being the watchdog for government transparency.... That is the entire function for the OIP to even exist - to interpret the law and force each department to comply with it.

Hmm, at least in theory, this would appear to make the OIP vulnerable to a writ of mandamus...

If any of the legal eagles can figure out some way to force the laws to be followed, I am delighted and offer anything I’ve got to that most worthy goal.

There has been a lot of monkey business at the OIP even with how Cathy Takase got the directorship after former OIP director Paul Tsukiyama was offered a high-ranking position by the corporation on whose board of directors Fukino sits (this happened shortly after Leo Donofrio said he would request that Tsukiyama take disciplinary action against both Fukino and Okubo).

If the OIP ever takes up these issues, I am sure they will interpret however they have to in order to cover everybody’s arses. They have not shown themselves trustworthy.
