How to Extort a Confession [Gerald Amirault] From April 22, 2002

The latest obstacle to Gerald Amirault's freedom came without fanfare. A three-member panel of the Massachusetts Department of Corrections has now decided that, since the prisoner has refused participation in treatment programs for sex offenders, he was considered to be "in denial." Permission for him to appear before the Board that could grant early parole would therefore be denied.

The world view of the social philosophers responsible for this decision does not allow for the possibility of wrongful convictions. In self-legitimating systems like this one, an unwavering assertion of innocence -- at whatever the cost to his hopes for parole -- is dismissed as "failure to take responsibility." Mr. Amirault's mother and sister were denied parole for the same reason and were freed after eight years only because a lower court judge overturned their convictions on child-abuse charges.

Let us review where we are in the tortured history of this case. Last summer the tough-minded Governor's Board of Pardons unanimously called for commutation of Gerald's sentence. Six months later acting Governor Jane Swift decided that her abysmal standing in the polls might be improved by rejecting the Board's commutation grant. Political sages assessing her failed gubernatorial career cite her behavior in the Amirault case as one of the political miscalculations that have cost her.

And what has it cost the man the Commonwealth has kept behind bars for 16 years? One of the few recourses left to Mr. Amirault was to ask for another appearance before the Board, this time to request early parole. Unlike a grant of commutation, a parole grant requires no permission from the Governor. He has now received the answer to that request. It still may not be the final one given the possibility of successful appeals to higher authorities such as the Commissioner of Corrections.

Why does the author think he is innocent? There seems to be some info missing here.

Because the evidence against him was acquired by browbeating four-year olds for days until they agreed with the interrogators.

This is why the children 'remembered' being raped by robots, by clowns in hot-air balloons and so on.

The coercive witness interviews used to frame up the Amiraults are now literally used as textbook examples of how NOT to interview children.

Despite the breakdown of the evidence, the totally innocent Gerald Amirault still to this day has to wear a GPS anklet. Which he pays for, BTW.

If he participated in this program, it would be the same as affirming his guilt, and, he would be eligible for parole.

It should be remembered that the individuals accused of witchcraft in 1692 were given a similar choice - admit that you are a witch, and no punishment would be levied. Deny it, and you hang.

Those individuals could not and would not admit to a lie, and so 20 men and women were executed. Gerald Amirault cannot admit to this lie.

Coakley is the prosecutor who railroaded the Amiraults, hiring shrinks to press children to make up bizarre stories of sex abuse. She makes up monsters at home for personal political benefit, while ignoring monsters abroad. (According to her, “there are no more terrorists in Afghanistan”). She is certifiable - they ought to lock her up and throw away the key, not give her a Senate seat.

All three segment should be required reading of every American over the age of 15. Never again.

From Ms Rabinowitz’s recent piece at the Wall Street Journal: Gerald Amirault spent nearly two years more in prison before being granted parole in 2004. He would be released, with conditions not quite approximating that of a free man. He was declared a level three sex offender—among the consequences of his refusal, like that of his mother and sister, to “take responsibility” by confessing his crimes. He is required to wear, at all times, an electronic tracking device; to report, in a notebook, each time he leaves the house and returns; to obey a curfew confining him to his home between 11:30 p.m. and 6 a.m. He may not travel at all through certain areas (presumably those where his alleged victims live).
