An Orange County man accused of texting while driving and hitting and killing a pedestrian has been ordered to stand trial for gross vehicular manslaughter.
Superior Court Commissioner James Odriozola determined Monday that there was enough evidence that the crash was caused by more than ordinary carelessness and denied a defense motion to lessen the charge to a misdemeanor.

We are going to see more of this. People are sometimes really, really stupid.
Many, many people are just this thoughtless and stupid because the horrible thing is NEVER going to happen to them.

My Step Mothers Mom died in an auto ped accident just like this. A 60+ driver was texting while driving through a parking lot. and hit the 80 yo.
Sad.
One life taken.
Another one destroyed.
For what? Because someone just had to stay connected, they couldn’t drive down the road without being a slave to that?

IMO,
Sober drivers ie; stupid, ignorant, distracted, or just plain “drivers with no common sense” are worse and kill more people than drunk drivers.
The only reason sober drivers get a free pass for killing someone with their incopetence is because they are “sober” and walk away with just a ticket for the most part.
In all my years of driving I have been almost killed or been screwed over on insurance scams by the sober/stupid drivers.
I don’t think just because you can afford a car you should be able to drive.
You should be able to pass a “common sense” test.

You’re right. Sober/stupid does get a pass.
This guy does not deserve “gross vehicular manslaughter” if Ted Kennedy did not. Technically, Leo Damore suggested Teddy be up for “Negligent Homicide” since his negligence led to another person dying.
This is not equal justice.
Anybody caught texting-while-driving should have their license revoked.
