This July 14th-'09 Federal FDA power-grab over the entire tobacco industry MUST BE OVER-RULED BY THE SUPREME COURT ! ===================================== *   This UNCONSTITUTIONAL CONTROL ATTEMPT by Obama and his fascist comrades in the Congress using the power of the Federal Gov't. would ELIMINATE the existing FREE-MARKET SYSTEM for ALL tobacco products AND IS UNPRECEDENTED in ANY present and past regulatory legislation NOT OVER-TURNED BY THE HIGH COURT. THIS OBVIOUS ABUSE OF AUTHORITY WILL NOT STAND. *   The SUPREME COURT has ruled to STOP this type of ABUSE of Federal regulatory power aquisition and clear collusion of the executive and legislative branches of government in N U M E R O U S CASE LAW rulings OVERTURNING TYRANICAL LAWS in the past. ======================================  Despite the negative effects of alcohol  use/abuse on society in the U.S., NEVER has an atempt been made to grant to the Federal Gov't., through the FDA, the power to DECIDE THE PROCESS OF MANUFACTURING ALL ALCOHOL PRODUCTS and THE VARIOUS INGREDIENTS USED.   THIS ENTIRE CONCEPT IS ABSURD and UNWORKABLE in the extreme.

  ALL Federal Gov't. statistics regarding mortality effects from smoking and secondary tobacco smoke are BASED ENTIRELY on SYSTEMS of ESTIMATION in place of HARD PROVABLE FACTS. THESE INCLUDE those deaths from FOREST FIRES, FLU, PNEUMONIA, etc. READ-THIS-RPT.GAO-03-942R where 15,576 Flu and Pneumonia DEATHS ARE CLAIMED TO BE CAUSED BY NOT GERMS, BUT DIRECTLY BY SMOKING. "causally linked" means "CAUSED BY".

The GAO is a group of NON-SCIENTIFIC ESTIMATORS. Just by insinuation do these "estimations" magically become "FACTS" in the minds of those who predetermine the results they want. *   The Wash. Research Service concluded years ago that an estimated impact on the U.S. Medicare program from tobacco smoking to be approx. $.33 cents per pack of cigarettes sold/USA which is MORE than covered by the $1.09 per pack FEDERAL TAX NOW IMPOSED ! *  ANY FURTHER REGULATION by MANIPULATION of the FREE MARKET PRODUCTION of TOBACCO PRODUCTS is NOT NECESSARY FOR ANY REASON and BY ANY RATIONAL REASONING PROCESS WILL NOT PASS A CONSTITUTIONAL CHALLENGE in the U.S. SUPREME COURT. *   U.S. Senator Sam Brownback,( and other politicians I'm sure), have sent out FABRICATED FORM LETTER RESPONSES to those they claim to represent. Our stupids in Govt. have made it so tobacco pays for a whole lot of govt. crap.
What is govt going to do when they’ve made it so no one can afford to smoke? Then who or what will be the sugar daddy?

Though I oppose smoking, I can't help but believe that 0bama has a checklist to destroy American industries, one by one:

1. Banking

2. Insurance

3. Auto

4. Defense / aerospace

5. Tobacco

What's next? Coal? as promised during his campaign?

The almost certain efforts by the FDA to “regulate” cigarettes will raise the price and further limit access to them. This will be killing for states who have raised tobacco taxes as a means to balance their budgets. Already we are seeing a thriving black market for cigarettes and increasingly expensive efforts by states to fight bootlegging. I see an enormous opportunity for organized crime similar to that handed them by Prohibition.
