A former Border Patrol agent's lengthy sentence for shooting a fleeing drug smuggler had been described as extreme by his supporters, but a federal judge showed no mercy Wednesday at the former agent's resentencing hearing in El Paso, Texas.
The judge upheld Jose Alonso Compean's original punishment and resentenced him to 10 years in prison for his conviction on a charge of using a weapon in the commission of a felony and another two years in prison for assault and other charges, the U.S. Attorney's Office said.
Compean's attorneys plan to turn to the Supreme Court for a review of the case. Bob Baskett, an attorney for Compean, did not immediately return a call for comment from FOXNews.com.
Compean, along with former agent Ignacio Ramos, was convicted in 2006 of shooting Osvaldo Adlrete Davila an admitted, and now convicted, drug smuggler and trying to cover up the shooting.

Bush should pardon these two but I doubt he will.
Funny I just heard a commercial on the radio “ become a border agent” Yeah right, thier going to open the borders wide on all fronts anyway so just don’t bother! It was a lovely country for a while there! God bless America she’s bleeding from an artery with no paramedics in site. I am in mourning!
“Strange” this story didn’t name the judge, nor did the El Paso Times story name the judge. Hmmmmm.

Bush is useless...worst Republican president to have won two terms in office.
These two need to be pardoned by President Bush, immediately.
This unfathomable miscarriage of justice will only be remedied by pardon, at this point. They have suffered far too much for this alleged crime.
We need to wake up to the reality the our border is our primary line of defense against a whole host of ills, and it must be secured. These two agents, acting in good faith, shot a confessed drug smuggling illegal alien in the arse, and they get sent to prison. Unconscionable!

Why haven’t other border agents come to their defense and protest or walk off the job?

Sorry, but after 51 years of liberal judges playing games with people lives, including my. I just don’t feel like showing any mercy what so ever. And that what they do, play games on peoples lives. And that not helpful.

Things sure did go south in his second term.
Since the Schultz case received nationwide notice (and no doubt a lot of notice with the ranks of the federal prosecutor's offices) you'd best believe Sutton knew all about it, and the normal standards the FBI applies to shooting situations.
Obama could do us all a favor by having Sutton prosecuted for misprosecution.
Does anyone know how to get a message to President-elect Obama concerning these two men’s fate? Perhaps, the in-coming President would like to demonstrate compassion and that he is all the people’s President.
The judge had no authority to reverse the previous sentence other than the portion remanded back for resentencing... The following from another article back when it case was remanded for resentencing. In other words the 10 year minimum wasn’t at issue.

The 5th U.S. Circuit Court of Appeals threw out some convictions against Ramos and Compean earlier this year, prompting Wednesday’s resentencing, but the court upheld the majority of the case. Ramos is due to be resentenced Thursday.
I have been disappointed in Bush for a lot of things but none more so than his not pardoning these guys.

FORMER BORDER PATROL AGENT JOSE COMPEAN RESENTENCED TODAY
United States Attorney Johnny Sutton announced today, that former Border Patrol Agent Jose Compean was resentenced this morning by United States District Court Judge Kathleen Cordone to twelve years in federal prison - the same sentence originally imposed for his role in shooting an unarmed fleeing suspect. Mr. Compean was resentenced on the assault, civil rights and use of a firearm during a crime of violence charges.
On July 28, 2008, the Fifth Circuit, in upholding the majority of Compean and Ramos’ convictions, stated that [t]he trial of the case was conducted fairly and without reversible error. While the majority of the charges against Mr. Compean were upheld, the court did remand the case to the District Court for resentencing after it vacated the obstruction of justice charges.
Agents Jose Compean and Ignacio Ramos were indicted by an El Paso federal grand jury and were convicted after a 2 ½ week jury trial in which both defendants testified. The Fifth Circuit affirmed the most serious charges against them and has denied their request for a rehearing on the matter.
Will Bush pardon him?
I think Sutton is a lying pos. We have no idea if the drug-runner was armed or not since he got away. They fired 15 shots, so what?
I would have given them a raise for every drug-runner they shot in the ass. Did Ramos and Compean make some mistakes and neglect procedure? I think so. My problem lies in our Government siding with drug-runners and in the trial the defense was not allowed to tell the jury the whole truth.
I would think being a drug-runner is information that goes directly to the credibility of the testimony he gave. The trial has every appearance of a snow job. It is wrong, and if Bush does not pardon these men then he is no better than Sutton.
Nobody standing up, taking charge, and waving the flag? And the few that have the cajones to do it will be either dismissed as nuts or shouted down by everyone else saying "you're making us look bad!"

Yes the media fawned all over McCain in the primaries with as much energy as they demonized Palin. It should be obvious that the media spews its venom at those they fear the most. The media spewed their venom at Romney. The anti Mormon conservatives obliged the Media and killed the best chances they had of stopping Obama.

About 15 years ago a friend of mine was fishing on the All American Canal with his family. Some illegals on the south side of the canal were taunting him and his family. When one of them ran across the check, he grabbed a Border Patrol service shotgun from the trunk of his car and shot that idiot in the ass. He had to pay a judgement and that was it. The Border Patrol sure has changed.
They did not file a false report and they did not destroy evidence. These myth just won’t die.
Not to worry; President Barabbas will soon start CPR, and pump'er dry.
Fortunately he will keep that title. He almost had a challenger with McCain.
