But Eddie Van Halen has no say in the matter.

Dude... McCain needs to stop treading on the copyright... Its kind of embarassing... It isn't any form of copyright infringement as long as McCain pays the appropriate royalty. Same way Rush gets by with a lot of his bumper music

actually no.
if the venue pays a flat royalty fee like most venues, the use IS paid and IS permitted.
It also depends on the licensing.
I suspect this is more about some musicians being “dixie chicked”.
