I don't think it's incorrect at all. Keeping in mind the Court's current MO that the 14th Amendment incorporates enumerated rights, I think it's entirely accurate to say the decision "makes clear" such bans are unconstitutional, even if it doesn't expressly state it.
Incorporation’s an obvious future step, but it hasn’t happened yet, and McCain’s stating otherwise is just wrong (not that he actually writes his own press releases, but someone jumped the gun here).
