Actually, one can probably argue that the legal “discouragement” of setting booby-traps is a common law tradition with a lineage of at least a couple hundred years.

true, but there were RATS even back then... as far as i can see it's merely a law to protect criminals and prosecute the victim.

Activist judges don't care about the law, common or otherwise. They are more inclined to base their rulings on what feels good to them at the time.
