This could be an interesting test case, pitting the explicit right of free speech in the Charter against the state’s ability to regulate speech that it doesn’t like. In the US, this type of law would not withstand scrutiny. But my betting is that our SCC will ultimately re-write the Charter to make the guarantee of free speech a total sham.
The test case happened already in 1990, and Taylor was the guinea pig. The Supreme Court ruled that Section 13 complaints can overrule ones right to freedom of expression. The Supreme Court ruled 4-3 in favour of upholding section 13 as demonstrably justified in a free and democratic society. Chief Justice Dickson ruled that upholding tolerance in a multicultural society superseded ones right to freedom of expression.
I don’t understand how limiting somebodies guaranteed right to freedom of expression and freedom of the press is justifiable in a free society. It’s mind boggling. Why does the Government even have the word “freedom of expression” in our Charter anymore? They should have just removed it in 1990.
