Schindlers' Options Dwindle to Hearing Tonight with Federal Judge (Motion DENIED)

A federal court hearing has started in one of the last effort attempts by Terri Schiavo's parents to restore their daughter's feeding tube.

But the judge already has turned down the parents once. Bob and Mary Schindler are asking for an emergency order to reinsert the feeding tube in the brain-damaged woman.

The hearing in Tampa is before U.S. District Judge James Whittemore. He turned the Schindlers down once, as did a federal appeals court and the Supreme Court. A state judge, a state appeals court and the Florida Supreme Court also have all come down on the side of the husband, who wants to let his wife die after 15 years in what some doctors call a vegetative state.

The latest defeat for the Schindlers was today when a state judge said he won't go along with Governor Jeb Bush's request to order the feeding tube reinserted. The governor had said that new allegations of abuse of Terri Schiavo need to be investigated. The governor also tried to challenged the diagnosis that Terri Schiavo is in a persistent vegetative state.

Was there due process in Florida?

Many think so, in which case you'd be right; the Feds should have stayed out of it.

I do not think so, in which case I'd be right; the Feds were right to get involved.

Now, I don't disagree that everyone in Florida went through all of the motions but, it's like a rain dance; wearing the right costume and going through the motions just doesn't cut it if the water doesn't fall when you're finished. You can do a great job of practicing law, but that isn't the same as ensuring justice; just ask William Penn. (ref: http://www.juryduty.org/lawrence.htm)

If the goal of due process is justice, and justice is not done, then that ought to be our first indicator that due process was not done, either.

Sometimes being right and being righteous are completely different things.

And I KNOW that you of all people are not laughing, nor are you a Nazi. I know that for a fact, because I have seen you as a caring person.

I also find it sad that a lot of names I am used to seeing are just not here.

Sometimes emotions get heated but we've got to understand that we all stand for the same purpose.

Whenever I see these talking heads floating the GOP "talking points" about how great the 'issue; of Terrie would be, as if her death would be a great thing for the Republican party, well that is nuts!

Where are all the liberals who scream and scramble to preserve the lives of the most wicked murderers on death row?

Where are all the liberals who tie themselves to trees and lay down in front of tractors to protect the snail darter?

And where is the President of the United States and the Governor of Florida - who swore to uphold the federal and state Constitutions? They have forgotten that the Executive branch is an equal branch to the Judiciary. They have lost their moral compass by NOT exhibiting backbone. They need to send in Federal troops or the National Guard and let the courts know that WE THE PEOPLE will no longer allow them to
tyrannize us. No food and water? What are we becoming? This is beyond shameful - it is barbaric!

Let me get this straight: so the unelected, lifetime tenure lawyers-in-black-robes have supreme power to block Congress, the President, Governors, Legislatures ... And who decided this? Why, unelected lifetime tenure lawyers-in-black-robes!

t appears they do have supreme power in a sense.

We have given them the power to decide these matters and even though congress and GWB tried to change the outcome they still left the decision up to the men in robes> Jeb has left it up to the men in robes too.

I just did a little internet research in the Florida courts and Greer is assigned to the probate division. So that would make him a probate judge.

OK. So now you don't have to doubt strongly the assertion by some that he is a probate judge. Unless I misunderstood the exchange at 250 / 233.

Apparently he's not even a state judge -- he's only a County probate judge!

What is wrong with the little minion's brain Colmes, on the one hand he says we may be on different sides here,and that new dr. diagnosis is no good and bla bla bla,arguing the merits of M. SChiavo's case. THen he asks them if they want charges of murder brought forward...
How can he on the one hand be for Terri's execution,and in the same breath mention allegations of murder.

It's an emotional issue, unfortunately it's gotten to the point of catch 22. It's largely been made by judicial abuse of power (Greer blew it, no way around that), and it's building to the point where the only way to fix it is with executive abuse of power. Neither is a good thing, and piling one on the other is just plain bad.
