White Put Politics Before Prosecution

White once was on the receiving end of accolades for securing guilty pleas against Clinton fund raisers. But then nothing happened.
The words were ones of unstinting praise: "Mary Jo White's dedication to justice is unquestionable, and her term as U.S. attorney has been one of steadfast commitment to law enforcement. She is a dedicated public servant and top-notch prosecutor."

If these parting sentiments had come from anyone other than U.S. Attorney General John Ashcroft, a Republican, few would have thought twice about the nation's top law-enforcement official blowing a little sunshine White's way. But many familiar with the New York prosecutor's record on politically sensitive issues [see "Blind Justice?" April 2-9] found themselves wondering whether Ashcroft completely misunderstood the Clinton-era corruption cases or whether he was covering his delight at being rid of White with an ironic diplomacy.

In any case, with White's announced end-of-the-year departure, a yet-to-be determined replacement as U.S. attorney for New York's besieged Southern District undoubtedly will be stepping into a kind of political ground zero where critical insiders say the chance of any aggressive prosecution of the Clinton corruption probes always was about as likely as a definition of the word "is" by the since-disbarred Bill Clinton. At the top of the hoary heap of unresolved but not forgotten business is the 1996 Teamsters Union election scandal.

To some it seems but a moment ago that White found herself the recipient of accolades when in 1997 she announced the guilty pleas of Michael Ansara, a telemarketer, fund-raiser and consultant for the Democratic National Committee (DNC); Jere Nash, campaign manager to Teamsters' then-president Ron Carey and a consultant to the 1996 Clinton/Gore re-election campaign; and Martin Davis, a political consultant to the DNC. All had pleaded guilty to conspiracy, mail fraud and embezzlement for their part in political fund-raising schemes that were a kind of shell game involving the Clinton/Gore re-election campaign, the Teamsters treasury and the re-election campaign of the Teamsters president.

Illegal fund-raising schemes had been put in place to funnel Teamsters money to the Democratic Party in return for the Democrats diverting large sums of money back into Carey's 1996 re-election bid.

Thanks to White and her "dedication to justice," critics say, this was for all intents and purposes the illegal fund-raising cover-up of the decade. But four years later, convicted conspirators Ansara, Nash and Davis still have yet to be sentenced. There have been many control dates — scheduled appearances for sentencing — the most recent last May. But all have been scrubbed even as the convicted conspirators have continued business relationships with the DNC.

The reported reason for the continually cancelled control dates? According to White's office — which tends to treat the sentencing status of the three felons as a state secret — Ansara, Nash and Davis still are "cooperating" with the prosecutor and are, after all, rescheduled for sentencing in February 2002. Given that the latest dates for sentencing come months after White's scheduled departure, observers in the Justice Department note the alleged coincidence of the felons not having told all they had to say until their benefactress White was to be replaced.

But the information that there is no information has been the standard line in the New York office of the U.S. attorney on these matters going on four years now. And Insight has confirmed that for months official Washington has not been buying the "they're-still-cooperating" line, but wondering what additional relevant information these confessed felons could provide about what only can be called an open-and-shut case of illegal Democratic fund raising.

Lawmakers acquiesced years ago to White's appeal that they refrain from subpoenaing these players to answer questions before congressional committees on grounds that their cooperation was important to other prosecutions. But it now appears to GOP insiders on Capitol Hill that White had other motives of the political kind for burying these crimes.

Rep. Pete Hoekstra (R-Mich.), chairman of the House Education and the Workforce subcommittee on Select Education and former chairman of the subcommittee on Oversight and Investigations, tells Insight that White's departure has left him "speechless." He explains, "The problem is that the things she has neglected can never be dealt with now. Every time I get a call about the Teamsters scandal, it brings back the same old emotions of outrage because this is an issue that could have been and should have been dealt with years ago. The federal government had its hands all over the Teamsters scandal years back and has done nothing with it because of White. I've been fairly clear about this, and if I ever get into this situation again — of acquiescing to the Justice Department — I'll decline and go for the records."

The Michigan lawmaker continues, "The fact is, they kept telling us 'We're moving forward and you're going to jeopardize the investigation if you interfere.' Five years later someone ought to be asking Mary Jo White, 'When you told Congressman Hoekstra that the committee couldn't have any of this information on the Teamsters, what exactly was the ongoing investigation to which you were referring?' We spent a lot of time and resources on the Teamsters scandal trying to help the union take care of itself, and they got absolutely no help from their watchdog, which in this case is the federal government, because Mary Jo was handling it. Of course now we know that's not the case."

Congressional oversight isn't the only watchdog smarting about White's alleged deceptions and inaction. Former federal prosecutor Larry Klayman, now president of Judicial Watch, tells Insight that "Mary Jo White is a political hack." He says: "After four years these guys — Ansara, Nash and Davis — should have said all they had to say. The average person, those not politically connected, wouldn't be able to do what these guys have gotten away with. But then again, just look at the way White has handled other more recent cases like [Clinton's] Pardongate. It's all very political. And she knows that if she ever wants another job politically she's going to have to go through [Democratic New York senators] Hillary Clinton or Chuck Schumer. … The overall concern is why the Teamster case took so long. The answer has to be that White didn't want to win this case, she didn't want to get these guys sentenced. It would have been a career-ender."

Klayman's summation fits with Hoekstra's contention that White was engaged in politics rather than prosecution. "It just amazes me," Hoekstra says, "that she leaves on her own schedule, terms and conditions. I would have thought that she would be gone on January 20 at 12:01. She was one of the people that a number of us said should be gone early in the process, and I have no idea why she was allowed to stay on so long. This is the most important U.S. attorney position in the country, and it surprises me that President [George W.] Bush wouldn't want someone from his own team from day one."

The lawmaker wonders if there is some method to the seeming madness. "My understanding is that some of these indictments may be beyond the statute of limitations. That would make it really interesting if White stayed on just long enough to make sure that the statute of limitations had expired. We're not talking about the three guys who already have pleaded guilty, but rather the other players, like newly anointed DNC Chairman Terry McAuliffe or Richard Trumka [secretary-treasurer of the AFL/CIO]. The concern, of course, is that with Mary Jo leaving without prosecuting any of the others with clear connections to the scandal, it puts an end to the Teamsters investigation. Not only has she stretched it out as far as she could, but now the stalled judicial-appointment process will pretty much quash any further attempts of the incoming U.S. attorney to prosecute the case."

The Michigan lawmaker may be right about this, but so far it has proved as hard to get a straight answer from the New York prosecutor as to find Osama bin Laden. In response to questions about the statute of limitations on the fund-raising swap schemes, a spokesman for White tells Insight: "We can't comment on that subject."

Ashcroft should be forced to resign by the Right because he seems fully prepared to coverup the Clinton Corruption AT ANY COST to his own reputation and the reputation of Dubyuh's Department of Justice!!!

What would you have had Dan Burton's committee do? Barbara Olson did much of the work on that committee. Was she the jerk you make Burton out to be too? I'm suprised Burton bothered at all. He got years of attacks from the left for continuing the hearings and many on the right bashed him because, I suppose, they thought he had police powers he didn't.

And what makes him think that she doesn't fit in with the Bush presidential plans? And isn't part of his team.

While Bush claims to be a lot of things, such as Pro-Life, he is turning out to be a Bush the first, except on fighting the war, on that he gets high points.
