After Sylvestre’s trial in 2006, the London diocese revealed it had found — in the back of a diocese filing cabinet — the Sarnia police reports from 1962.


A few thoughts:

1) The insurance company didn’t do their due diligence with public records nor did they ask the insured about the risk?

2) Even thought I can see both sides, I think it is good to shine the light on the situation.

Insurance contracts are governed by the legal doctrine of Uberrimae Fidei. The insured must disclose all relevant information to the insurer so that they can properly assess the risk they are assuming. If the diocese knew about these pedophile priests they had an obligation to disclose the fact.
