Can’t the commissioner be sued for illegal denial of free speech ?
Oregon may foolishly have given him authority to levy fines but can’t give him authority to deny speech.

Levy fines but based on what? Feelings? Subjective interpretations of law? If he has unfettered ability to levy fines for any reason, then he can fine every Christian I n the state just for being a Christian, or fine heterosexuals for being married to the opposite sex, or fine conservatives for not being liberal
By what authority is he given the ‘right’ to violate the constitution by levying a fine on someone who exercises their constitutionally protected RIGHT to free speech?
