Of course they do! What, we expect them to automatically reject proven tactics and try something else just for the sake of novelty? Kind of a dumb criticism.
OTOH, the other side has an incentive to try something new, since what they tried last time resulted in a loss.
Smart generals are those who can react, adapt and overcome in a new environment and with new tactics.
The problem is that it’s presented as a Church v State issue. It’s not. I have no need for an insurance policy that covers infant murder or contraceptives. My wife doesn’t either. Yet the HHS mandate says that everyone must be covered for these things, and covered for ‘free.’
What’s next? Requiring car insurance to cover oil changes? Tires? Gasoline?
I still can’t believe that every state insurance commissioner isn’t standing up and going ‘oh hell no’ about the feds stepping in and replacing them.
The author makes good points, but this will be about money. When local govts are faced with the cost of replacing Catholic services the call for Obama’s retreat will be overwhelming. If the bishops stay the course they will win and with bright engaging leaders like Tim Dolan they will not be fooled again and will be on guard.

The author is correct on this: the Church should say unequivocally that running charities and hospitals they way the Church wants to run them is a part of being Catholic and is a constitutionally protected activity.
This trumps ANY statutory provisions the government might have in the secular sector such as equal protection of gays, statutory legality of contraception or statutory legality of abortion.
The Church should not threaten to close down the hospitals or other organization affiliated with the Church. The threat instead should be to enforce strict Catholic moral discipline in them, — for example, fire dissenting nuns, nurses etc. The Church should state that she does not intend to obey anti-life laws and mobilize the Knights of Columbus to thwart any use of physical force by the government against Catholic institutions.
The window of opportunity for the defense of religious freedom is closing. Any cave-in on the part of the government should be taken as a matter of course, and more assertive Catholic policy should follow, till a political climate in which no intervention by the government in the internal affairs of the Church is thinkable, prevails.

The Democrats have worked their politics into the Church over many years, and we only have a short time to peel some of that away, but with reason and with a charitable attitude, I think it can be done. Being ugly and mean with our fellow Catholics, even if we do think they're being thick-headed, won't work. It will just enforce their own attitudes about Republicans, and won't give them any reason to vote for them in November.
