Professor Douglas Kimec: Sandra Day O'Connor is in Europe on vacation...

[O'Connor is the justice assigned to hear emergency appeals from the 9th Circuit]

He wasn't sure what impact this might have an on appeal to of the recall decision. Professor Kimec believed that an en banc review may be a better avenue of appeal at this time.

I heard Judge Napalitano on FNC say that Justice Kennedy could issue a stay. Maybe he is assigned to cover for her.

Justices of the Supreme Court are ALWAYS reachable, and ALWAYS on duty if the Court Rules so require.

I recall the legendary story about the late Justice Douglas. Some lawyers wanted his one-Justice recision on an environmental case. They hiked two days into the woods to find the Justice. He read their papers, and signed their Order. Then they hiked two days out to get that Order to the Clerk of the Supreme Court.

Given faxes and cell phones, I believe that Justice O'Connor is already reviewing this case through her Clerks, knowing that it will wind up in her lap. If she signs an Order on the Champs Elisee in Paris, it will be just as effective as if she signed it in her Chambers on 2nd Street in Washington, D.C.

Europe may be old-fashioned in many ways, but they have phones, fax machines and overnight delivery services. Justice O'Connor is (or can be) as available there as she would be in Washington.

Given some of the AWFUL opinions SCOTUS has handed down of late, I tend to agree that they will refuse this case. But hey, that gives your boy McClintock more time to play spoiler.

Unlike here in the advanced civilization, they have SMS mobile phone messaging in Europe. Sandra can simply SMS her stay order!

Didn't they refuse to step into the New Jersey Senatorial ballot issue (Lautenberg/Torricelli)? This was a clear violation of state law as well.

Different issue. In NJ, a state court violated its own laws, whereas in this case a federal court is violating state laws. (And in Florida 2000, a state court was violating laws involving a federal election).
