Yep. Although I don't listen to him much anymore since he's changed stations and air times, I used to listen to old George Putnam's radio talk show most days while at lunch. He never failed to miss an opportunity to remind his listeners of that fact.

Jon Scott was great interviwing Torres on FOx News. Torres was going ballistic trying to come up with an answer for why the Dems didn't argue this point last election. Then Scott says (paraphrasing) "I've read the brief and help me to understand the second argument; the court says minorities don't know how to use the equipment, why can't they use the equipment like everyone else?".

Torres stuttered that he hadn't read the brief yet and uh, and uh, and uh......

I've read the decision, and I have to say, what a bizare ruling. Judging from how it was written, choices in language and issues not part of the case, this decision was written with the intention of being overturned. Which makes me wonder if the intention was to force the SCOTUS to overturn /and/ come up with a reason that would weaken the rulings of Bush v Gore, giving a double victory to Democrats who will use both to bash the 'right-wing' SCOTUS and re-energize the vote for 2004.

Bingo! That's exactly what I think. The Dems aren't merely trying to keep Davis in power, heck, they know he is weak and they could do without him. They are playing for the home-run; that is, bringing up the canard of "disenfranchisement" again for 2004. And they can count of millions of myrmidons to fall for this stunt. Thus, you see Clinton and his cabal strutting around right now.

Interesting how various sectors were labeled as unable to use this voting system, them same sectors the leftists have been "improving" lifestyles, educations, employment... for the past 4 decades?

I live in "wealthy" North Orange County, I have used punch card ballots my entire life, I've NEVER heard of anyone complaining or being "disenfranchised".

I live in San Bernadino county and have used punch card voting machines in every election I have ever voted in. You mean I have disenfranchised the entire time? No wonder none of my Republican candidates have ever won.

This is different - the NJ SC is a state court - the 9th Circuit is a federal court, and SCOTUS has jurisdiction.

Once again, the United States Supreme Court has appellate jurisdiction over both federal circuit courts of appeals and every state supreme court.... article III of the Constitution of the United States of America.

Actually, I would be surprised if they actively affirm this.

On that we completely agree. I would not expect a ruling to sustain the 9th Circuit. I would anticipate either a summary affirmation or a ruling that overturns for one reason or another. Maybe I didn't make myself sufficiently clear previously. While, on its face, I think the 9th Circuit ruling consistent with Bush v Gore, I do not think it consistent with the actual intent of the SCOTUS. If the Supreme Court actually agrees to review, then I think they will clarify Bush v Gore and overturn.

However, I think odds favor the Supreme Court not wading into the morass at all. From their perspective, this is the sort of one-time circumstance which doesn't require the establishment of enduring precedent. Yeah, we might think it's imperative that the recall take place in October rather than March, but in the grand scheme of things, it's a rather trivial distinction in the nation's history.

In short, I think the SCOTUS will not see fit to intervene over such an incidental point of law, when the underlying principles [voting machinery and equal standards] are still in a state of flux. I could very well be proven wrong...

Since I am a DUVAL COUNTY voter, and voted in the 2000 elections.

I would like to describe the horror of using the "punch card" ballot.


1. Find Candidate's name

2. Take poker and punch hole next to THE BIG FREAKING ARROW leading from said candidates name.

3. Take out ballot and hand over to official.
