Resign at this time? That's like saying the football game is over cause the other team scored a TD in the 1st quarter. I can't believe that Davis would give up so easy.

This DOES NOT CHANGE the recall. If Davis steps down, the recall goes forward, and whoever gets the most votes becomes the new Governor, regardless of who is holding the office at the time.

Relax, all. The recall statutes say that the election goes forward if the officeholder resigns after the election is certified.

Yes!

Had he resigned before the recall was certified, then we'd be stuck with Bustamante - however, too late.

He's probably going to talk about "fighting" like a bengal tiger again. He might even tell us all to ignore the Dems standing behind the curtain a la Wizard of Oz.

I may be wrong about this, but even if this recall election is avoided by Davis' resignation, there's no reason why Bustamante can't be subject to a similar recall effort after he takes office.

That's incorrect. The recall election would still continue.

Davis won't resign. There's no upside for him in that.

It will be something else.

Found this tidbit:

CA: Davis resignation won't help Democrats If Gray Davis resigns after the recall is certified, the recall election will still occur. Bustamante would become governor during the campaign, but the winner of the election would become still become Governor.

Of course, that could include Davis resigning, then getting elected in the recall!

This information is from Daniel Weintraub of the highly regarded California Insider. I emailed him asking about it.

Saw a plan the other day where: 1) Gov resigns (recall over), 2) Lt Gov becomes Gov., 3) Lt. Gov appoints Davis as Lt. Gov. 4) Gov resigns. 5) Lt. Gov (Davis) becomes Gov. 6) Gov appoints Lt. Gov. (right back where we started from, except NO Recall!)

Recall is not over, even if he does. The recall will be held and his replacement may be out then too. I suppose Cruz would just revert to Lt. Governor.

The election goes on. It is just a question of successor if he resigns.

This question has been answered a few gazillion times on this forum. The only way to stop the recall was to have him resign BEFORE the recall was certified...

I am no expert on California election law, nor do I live in California. But from what others have posted in the past, regardless of a Davis resignation the recall proceeds and the elected persons becomes governor.

And No Arnold is not a bad thing. As Rush said "Think Bloomberg with muscles." The guy is a raving left winger on most matters. He doesnt even begin to approach what could remotely be called a conservative.

McCauliffe and the Clintons have secredtly told Davis that things have changed and if he doesn't step down, they'll actively support the best dem on the ballot, which they will anyway.
