Sad. Very very sad.

I'm sure O'Connor is the culprit.

Yup. I guess we'll still have to live with state-sanctioned discrimination 'gainst whitey. Like we haven't paid enough for the sins of the past and still have to keep on paying... <sigh

I say, we wait and see what it actually says, before we get all worked up.....

IIRC Many called the Bush v. Gore decision a win for Gore, before reading the decision...

This shows how important the judicial branch really is. This is why we MUST fight for all of Bush's judges.

It doesn't seem to do any good. Seven of the current justices were appointed by Republicans, if I recall correctly.

I even have liberal friends who think that U of M is too far. Hearing that you get 20 points for being black or hispanic(but not asian or jewish), 12 points for a 1600 SAT score even offends some liberals sensibilities.

I don't see how this court bought this. O'Connor and or Kennedy I guess.

This is very bad for everybody. For a black student with spectacular LSAT's and SAT's they look suspect. For a white, asian, or jewish kid, they are screwed. For minority kids who are intelligent, but aren't ready for U of M, but do have the potential to succeed if they get back to basics at a less rigorous school, they will be more likely to drop out and fail.

Who wins... nobody.

I've considered becoming black. What if you just changed your racial categorization on all goobermintal forms and such? How could they prove you weren't 1/128th or some such?

From the Associated Press:

Court Upholds Mich. Affirmative Action

WASHINGTON (AP) -- The Supreme Court on Monday upheld a university law school admissions policy that gives minorities an edge, ruling that race can be one of many factors that colleges consider when selecting their students.

The ruling in the law-school case preserves the concept of affirmative action for minorities who might otherwise be underrepresented on top campuses, but makes clear that racial preferences must be used sparingly.

The 5-4 ruling endorsed a program at the University of Michigan law school meant to ensure a "critical mass" of minorities on campus. The program is not an illegal quota, the high court said.

A companion ruling testing the constitutionality of another, more overtly preferential affirmative action program for minority applicants was also expected Monday.

What was the issue difference between the law school and the undergrad school?

Separate admissions systems, separate cases, the facts of the matter were different. Wouldn't surprise me if they split the difference and throw out the undergrad system, that would sound like the sort of "political" decision the swing voters like O'Connor would make . . .

We can thank George Bush Sr. for appointing the far left liberal David Souter to the Court and Gerald Ford for appointing the same JP Stevens to the Court. They were told at the time that these were horrible appointments and they went forward with them anyway.

Race can be a factor but it cannot be a SOLE factor and must be used "sparingly." Those two phrases simply open the door to more litigation. Its by no means settled yet.
