Espionage case tied to racist groups

SPOKANE, Wash. - Former National Guard intelligence officer Rafael Davila admits he spent years bringing home secret and top-secret documents, stacking them in his basement and finally in a rented storage locker. He told the FBI he just wanted to read them.

Now in a case with ties to the shadowy world of white supremicists and anti-government militias, prosecutors are accusing Davila and his ex-wife, Deborah, of espionage. Investigators are still trying to track down hundreds of files apparently containing information about nuclear, chemical and biological warfare.

A federal indictment charges the Davilas with unauthorized possession of sensitive documents during the first eight months of 1999. Deborah Davila is also charged with trying to deliver the documents to an unidentified person in August of that year.

Deborah Davila is also charged with lying to federal agents when she said in 1999 she did not know Kirk Lyons of Black Mountain, N.C., a lawyer known for representing the Ku Klux Klan, White Patriot Party and Posse Comitatus. Lyons, who is not charged with any crime, said she attended his wedding at the Aryan Nations compound near Hayden, Idaho.

During a hearing last week, Rafael Davila, 51, sat silently with Deborah Davila, 40, as prosecutors vilified them, alleging that they exposed the nation to danger from terrorists and anti-government extremists.

"He doesn't care about the national security interest of the United States," Assistant U.S. Attorney Earl Hicks said of Rafael Davila. A judge ordered the two held without bail.

The Davilas, whose marriage crumbled in 1999 after less than a year, have pleaded not guilty. Prosecutors said there is no evidence that foreign governments are involved in the case.

The investigation began in 1999 after Deborah Davila called FBI agents in Spokane and told them that she had secret documents obtained by her husband. But instead of cooperating, she repeatedly lied to agents and obstructed the investigation, Hicks said.

According to the transcript of a rambling interview Rafael Davila gave the FBI in January 2000, he said he stole documents while he was a senior military intelligence officer with a top secret rating with the Washington National Guard's 96th Troop Command, based in Tacoma, Wash.

People live in "houses" "condos" or "apartments." Rich people own "estates" or maybe "ranches" or "farms" if there is some livestock or crop production. "Country clubs" if there are recreational facilities. The Elks "lodge"? The VFW "outpost" or "station"? A church "center"? But white supremacists, members of "cults" and "militias" only live in one place: "compounds." It makes them so much easier to lob in tear gas, obstruct the entryways with tanks, then ignite, and burn to the ground, occupants included. Just ask the Branch Davidians. The Murrah federal "building" had security cameras, underground gate-access controlled parking, an internal day-care center, an arsenal, sophisticated radio and microwave communications equipment, etc., but was merely a "building." If anything deserved to be called a "compound" it was that building. Would anyone doubt how bothered government agents would be if a group started construction of something like that, as their residence?

I’ve heard that Rafael Davila is a retired Lieutenant Colonel from the Washington State National Guard and that he is merely awaiting the 30th anniversary of “service” so that he can start receiving his “retirement annuity.”

To be tried in civil court for this is the wrong venue!  His actions are a personal insult to me as a retired service member as well as all of the military (active, reserve, guard, retired, and those who have fallen in battle or as the result of battle wounds).  He should not be tried in civil court but should be called to active service to stand Article 32 pursuant to a General Courts Martial.  Upon conviction he should be reduced to the rank of Private E-1, Forfeit all pay and allowances, be given a Dishonorable discharge, and confined to Ft. Leavenworth Military Prison awaiting his execution by hanging.

How could they know for sure no foreign government didn't get some of these documents since they haven't found them all?

He had so many he had to rent a place to keep them. Looks like someone would miss at least one of them.

From the above story I got the impression that the FBI had some of the documents and were trying to track down the rest. According to this story they have not recovered any of the documents.

THE STOLEN documents still have not been recovered, an FBI agent testified at a detention hearing for Rafael Davila, 51, and Deborah Davila, 46. Prosecutors said that because many of the more than 300 documents are secret or top secret, they could not specify what they contained. “They are worth, on the black market, millions of dollars, and would be of huge interest to militias and terrorist organizations,” FBI agent Lee McEuen testified. “Based on that, I believe they are a huge danger to the United States.”

Are you familiar with the Aryan Nation, and Hayden Lake, Idaho? I would not call it a residence.

But that aside the Aryan Nation no longer resides there.

Butler who was head of the Nation still lives in the area but now in a residence.

Maybe if she's looking for a deal she'll turn state's evidence on him and sing like a bird at his Courts Martial just to avoid a leathal injection.

From what I've been able to gather, she's the one that turned him in, then refused to cooperate. If she had a chance for immunity, it's long gone.
