BADA BING!! There you have it folks! Marc Levin knows his law stuff and he nailed it! WE'RE SCREWED :(
To: Alberta's Child
Belly laugh. Thanks.
To: randita
As much as I respect Levin, he is wrong. The Gore/Bush fiasco in Florida was a question of Florida law too, but had equal protection implications because it involved the rights related to running for political office. If the NJSC ingnores Florida law and allows the NJ dems to rewrite NJ law, it would bring up equal protection claims also.

I don't know whether to cry or laugh over this .....talk about making Jersey a laughingstock.. When I laugh it will not be directed at your state but at the fact that the wheels are coming off the Rats "scheme machine."
Hang in there.

Earlier this afternoon, Rep. Frank Pallone told Gov. James E. McGreevey that he would accept the Democratic nomination, but an hour later, he backed out of the race. Sources say that changed his mind at the urging -- or insistence -- of his wife, Sarah. I don't believe it. I smell a Hillary.
To: VRWC_minion
Someone told Pallone the odds of this working and he said he'd rather be a minority in the minority in the House.
Don't think he's not up for the challenge of subverting the law but if the odds aren't in his favor he isn't going to bet his Govt. paycheck on it.

On another thread, somoeone said that some absentee ballots, with Torricelli's name, have already been returned. Might be groungs for SCOTUS to intervene. Suppose someone comes out and says, "Hey, I voted, but I wasn't able to get another one of the new ones and return it in time. An now my old one doesnt count." That would seem to violate the equal protection clause, IMHO.

This is what the Dems are gambling on. They hope the GOP will take it to the SCOTUS in order to open up to old wounds and energize the Dem base throughout the rest of the country.

Unfortunately, the NJSC probably will let them do this. In that case, then the best shot we have is to publicly, and loudly urge people not to fall for the "bait and switch" the Dems are pulling.

I am not buying the wife excuse. How much difference is there in being a Rep from NJ in DC and a Senator from NJ in DC?
My guess is that these pols are finding out that there is almost zero chance of them actually getting on the ballot, and the odds of winning as a write-in are low.
To: randita
That's funny, Ben Ginsberg was just on Fox saying the opposite..he is looking to fight all the way to the SCOTUS...he said the RATS are not only breaking state law but federal law.
To: 11th Earl of Mar
I don't believe it. I smell a Hillary.I wonder how many vases were broken when Pallone broke the news?

"But I thought the Torch deal to withdraw from the race was contingent on NOT having Lautenberg replace him. Torch and Lautenberg are long time enemies."Lautenberg should accept and then call a press conference, bloviate like Torch for 45 minutes on his service, then say that the Rat party has left him and switch parties, announcing that he is running as Republican with his "new friend" Forrester...

Did Levin know about the precedent squarely against doing what the Dems want that dog found, Tomasin v. Quinn, 376 A.2d 233 (N.J.Super.L. 1977)?
To: TheBigB
Thats just lovely if he wins they can wheel him in next to STrom Thurmond.
To: All
Lautenberg is the idiot who praised Larry Flynt during the Impeachment, saying he was doing a great service to the country(or words to that effect).
Let's hope that he doesn't get his name on the ballot.
To: JeanS
At 78 yrs. sounds like Lautenberg is an interim pick. Once the senate seat is pinned down he can re-retire and another RAT put in his place. The question I have about this whole situation is why NJ democrat voters would be so offended by Toricelli's behavior but not by the manipulation of the law to install another RAT. They can have a writein for whomever the party instructs and if the dems are right it will be a shoo in for them.
To: hchutch
Gut instinct tells me ......they won't let the RATS pull it off...
