"September the 11th, 2001, cut a deep dividing line in our history, a change of eras as sharp and clear as Pearl Harbor," President Bush told the German Parliament on May 23.

A week later, in his West Point commencement address, the president introduced a new concept into American foreign affairs, a policy designed for the new era. In combating terrorist threats, he said, the U.S. will take "pre-emptive action when necessary to defend our liberty and to defend our lives." Since "the only path to safety is the path of action, this nation will act."

As to visiting aliens and resident aliens: Yes, they have rights under the Constitution. However, those rights are enjoyed by them only because there are here under our Constitution's protection. And they are here at our sufferance. They have no right under the Constitution to enter the US nor to stay here. They are here by our permission and we are free to revoke that permission at will. Thus the rights they enjoy can be similarly taken from them simply by deporting them to a location outside of our jurisdiction. We are well within our rights to demand that they submit to biometric testing or whatever to ensure that they are not a threat to us. If they object, then deport them and wish them well. They have no right under our Constitution to object to our demands.
