New York Attorney General takes initial step to prepare to seize Trump assets

(CNN) — The New York attorney general’s office has filed judgments in Westchester County, the first indication that the state is preparing to try to seize Donald Trump’s golf course and private estate north of Manhattan, known as Seven Springs.

State lawyers entered the judgments with the clerk’s office in Westchester County on March 6, just one week after Judge Arthur Engoron made official his $464 million decision against Trump, his sons Donald Trump Jr. and Eric Trump, and the Trump Organization.

Judgments have not been entered in Florida counties including Miami or Palm Beach where Trump’s Mar-a-Lago property and the Trump National Doral Golf Club and resort are located or Cook County, Illinois, where Trump’s hotel in Chicago is located, according to a review of records Thursday by CNN.

This is one case where a state might feel empowered to simply refuse to recognize the “foreign judgement” in question.

Correct. They can seize everything he makes over $560/week in income except certain social security and disability payments; everything in his bank accounts except those payments and I think certain funds for medical treatments and a few other designated uses, and everything he owns except $50,000 in home equity, a car up to I think $10,000 in value, wedding rings, certain business tools, an heirloom Bible, and a few other specific items.

Trump supporters among our elites are few and far between. They are all keeping quiet because they are thinking: "This is great! But I hope they don't try it on me..."

Trump Tower is a condominium, meaning the other tenants in the building OWN their residences. Exactly what power does this”person” have to evict these people for migrants?

Thing again. Sister state judgments are entitled to full faith and credit of each other under the constitution. A Florida judge or clerk cannot constitutionally reject filing New York’s judgment. I’ve entered out of state judgments personally in the past. It’s not hard, it’s just a little annoying since it just requires specific paperwork and affidavits you have to have filled out from the county clerk but it’s not hard to do - certainly not going to be a problem for the AG to get the right paperwork from the New York County Clerk’s office.

That sounds about right. From a PR point of view, selling Mar-a-Lago would be the most damaging outcome for President Trump. From the PR perspective, Letetia confiscating Trump’s New York properties would backfire, big league. Trump’s poll numbers would go up another 10 points.

The liens only count if they impair his ability to own or sell them.

The most comical thing that can happen right now would be for a buyer to come out and sign a contract to pay $1 billion for a Trump property that has a NY State lien against it.

She's not seizing a car, or equipment, or cash and jewelry. She's seizing real property that employs many people.

Seizing major commercial buildings like this makes it dangerously close to an illegal 5th amendment taking by the government as a back-door way around eminent domain and just compensation.

Yes, a “foreign judgment” can be enforced but you have a right to challenge it in the foreign state.

It is possible to challenge the attempted enforcement as fraudulent on its face which could involve criminal prosecution in the foreign state.

I’m not even a lawyer, but I know that a general rule of thumb for Federal courts is that appellants in state cases must pursue legal remedies in state courts first.
