“In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial”

The public needs to see the evidence too.

Trump is an old man and faces 37 counts as I recollect.

Pick a few documents that were sensitive when Biden was sworn in but no longer are.

There are hundreds of people within the government who can classify documents. Those same persons can also declassify them. It does not take the President.

It was Comey and his memos that led me to this conclusions. He classified them and then he declassified them when he got caught passing stuff to the media.

What classifying does is shorten the list of who can see them.

So who knows what they really have. I would guess that ALL the "supposed" classified documents that the President has are copies only.

I think (hoping) the judges decision is going to be a "gotcha" moment for not only the NARA but the entire crew of conspirators to keep Trump out of the race.

The judge may be calling Smith’s bluff. You are correct, Smith could choose something innocuous, then declare that as just a tepid example as the rest is so sensitive that he must keep it from their eyes.

That move though would risk alienating the jury.

I would expect Smith to as much as admit defeat as to the trial timing, by appealing this decision.
