The Brooklyn straphanger who shot a berserk rider attacking him on a rush-hour train Thursday will not be charged, prosecutors said Friday.
“Yesterday’s shooting inside a crowded subway car was shocking and deeply upsetting,’’ Oren Yaniv, a spokesman for the Brooklyn District Attorney’s Office, said in an an e-mailed statement.
“The investigation into this tragic incident is ongoing but, at this stage, evidence of self-defense precludes us from filing any criminal charges against the shooter.”
The shot man, Dajuan Robinson, 36, had bought the gun on the train and whipped it out during his attack on a stranger, who shot Robinson in the head as the pair wrestled over it.
Robinson is hospitalized in critical condition.

Some of the reporting earlier suggested the intended victim took the gun off him and then fired. This story says differently, that the gun went off when the two men were wrestling over the weapon.

ah, apparently I succumbed to the confusion oozing from this story.
Of course he won’t be charged. He shouldn’t be.
But let’s face it: the reason he isn’t being charged is he is not white and the belligerent was white.
If it was reversed, they would charge him.

the guy who brought the gun did not fire it, he threatened someone, that person (who was threatened) got the gun off him and used it on the person who originally had the gun.
So what about Daniel Penny, who merely put an aggressive and violent felon in a chokehold on the subway?
He’s facing 20 years in jail.
