“Fulton County Superior Judge Scott McAfee”

There are still a few righteous judges in this land! So far, because we must see what develops with this judge. He still might cave to Rat/Deep State pressure to screw The Donald.

^^^^^^ Translation here is that the sex-hound, imbecile Fanny Willis overcharged. But perhaps intentionally, so that this judge could look fair, by splitting it down the middle. To give some to Trump.

^^^^^^ With all judges trust but then super-verify. All judges can turn on you, like your gentle pet Pitbull.

Looks like McAfee may be getting ready to disqualify Willis and Fulton County but probably he will not be dismissing the case entirely.

He may just refer the remaining charges to an independent body for review and reassignment to another venue to avoid the political and legal fallout of dismissing the entire case.

This case has been an embarrassment to the Georgia legal since before it even began.

Recall the DA's office filed the complaint against the Trump in court before the Grand Jury had even met for deliberations.

The Defendants challenge Counts 2, 5, 6, 23, 28, and 38.

My favorite part:

"They do not give the Defendants enough information to prepare their defenses intelligently".

The charges were so bad that a defense was impossible to formulate.

REMEMBER: The purpose of Lawfare is not to win a conviction. It is to win a media cycle and destroy a person with THE process.

Rightly decided, but I absolutely hate footnotes 8 and 9. Fn 8 speculates on appellate remedies. The state knows what its remedies are, and there’s no need for this fn. the trial court should be confident in the correctness of its decision, and speculating that the appellate court will take the matter up should not be there. There is this popular notion, that is incorrect, that the state courts are subordinate to the federal courts. The state is sovereign and the attitude of the state court should be that state laws are sufficient for the adjudication of the matter. The para that states that the federal statutes are better has no place in a state court decision

As to fn 9, I suppose perhaps the issue was not before the court, but the problem, or what should be the problem, with the states case is that the defendants’ activities are First amendment- protected, and shouldn’t be criminally actionable at all

These are phone call-related (”find me the votes”) totally undermining the whole RICO case.

REMEMBER: The purpose of Biden/Willis type Lawfare is not to win a conviction.

It is to create an intense media cycle and destroy a
person with THE manipulated process of false publicity.

Seems the judge caught on quickly....Fani and $625,000 Wade’s
charges were so bad that a defense was impossible to formulate.

We can safely conclude, the first black woman DA, the vacationing Wade, and the Biden WH are so incompetent, they failed to give the Defendants enough information to prepare their defenses intelligently.

Georgia’s RICO Act, adopted in 1980, makes it a crime to participate in, acquire or maintain control of an “enterprise” through a “pattern of racketeering activity” or to conspire to do so. It’s important to note that the alleged scheme does not have to have been successful for a RICO charge to stick. An “enterprise” can be a single person or a group of associated individuals with a common goal. “Racketeering activity” means to commit, attempt to commit — or to solicit, coerce or intimidate someone else to commit — one of more than three dozen state crimes listed in the law. At least two such acts are required to meet the standard of a “pattern of racketeering activity,” meaning prosecutors have to prove that a person has engaged in two or more related criminal acts as part of their participation in an enterprise to be convicted under RICO. The U.S. Supreme Court has said that federal RICO allegations must show continuity, that is to say a series of related underlying acts over an extended period of time, not just a few weeks or months. But the Georgia Supreme Court has made clear there is no such requirement in the state law.

In the past I would’ve agreed with you, but now, they own the media and the cycle. I do agree that their goal is to destroy the person.

Slowly but surely, people are starting to realize that the Dung Beetle Party’s War on Trump, his family and his friends and associates is nothing more than a fascist “LAWFARE” blitzkrieg on Americans.
