It was never to “overturn” but to look into ballot counting problems, do some recounts, examine and investigate discrepancies and to delay certification until serious allegations were looked into.

1. The time to do that was BEFORE the electoral vote formalities were done in the states in mid-December 2020 (December 14th, I believe).

2. The inauguration date is established as January 20th. There was no way in hell any kind of investigation could have been done in two weeks. It was at least a year and a half before even a single jurisdiction completed its own audit of the 2020 voting.

Tim Scott supposedly said Pence did the right thing.

It was said today that, as a result, Trump is now no longer considering Scott for VP.

The 12th Amendment of the Constitution is quite clear about the duties of the VP regarding certification:

“the President of the Senate shall, in the presence of the Senate and House of Representatives, open all the certificates and the votes shall then be counted; — The person having the greatest number of votes for President, shall be the President”.

NO discretion is given to examine or validate or anything else. It’s a largely ceremonial role - to “count” and nothing more. I know FReepers don’t accept this but I could care less - I can read and in all of our history NOT ONE time has a VP acting in this role done anything other than to open the certificates and count them.

I fully support Trump and know full well he was cheated but you can either follow the Constitution like Pence did or you can raise hell because he didn’t make up some power he is not given by the constitution (which would have simply raised another crisis). I am certain if he had done so and thrown the nation into limbo, the only resolution would have come from the Supreme Court and they would have unanimously found that Pence failed to do his duty and certified the election of Biden anyway.

The Constitution is not perfect and the framers never envisioned a scenario in which citizens of a great nation would stoop so low as to cheat. The democrats knew it and took full advantage of this weakness in the constitution, and in the powers delegated to the states regarding elections, where it is easier to cheat.

Anything more or less is extra-constitutional, also known as “what Democrats do”.

Yes he could have. The Constitution does not in any place require rubber stamping.

And all of the deep state Unipartiers that claim to be conservative could have refused to certify.

The Constitution requires the VP -- as President of the Senate -- to open the certified electoral votes from each state. That's it. As the 12th Amendment says:

The President of the Senate shall, in the presence of the Senate and House of Representatives, open all the certificates and the votes shall then be counted ...

Guess what -- that really IS it.

The only discretion Congress has is in cases where one state has multiple certified electoral votes. That was not the case in 2020.

No. But what do you thinkg would have happened if Pence had been presented with a set of certificates and decided not to count and submit them as required by the Constitution? Do you really think the Democrats would have just said well shucks then I guess we’ll do some recounts and resubmit them and in the meantime Trump can just remain President?

It would have been a constitutional crisis and the country would have been outside of the law for the first time in history. With no precedent the only arbiter that would likely have decided the issue is SCOTUS. And they would have found that Pence failed in his duties and let’s just say, forced him to do so or done so or appointed someont to do so on his behalf.

It would have been a mess and by following the Constitution Pence avoided it.

No; there is no limitation in that text. Do you see the word “only” anywhere?

Not to mention “the votes shall be counted” does indeed imply legitimate votes.

I'm the VP of the United States. It's January of 2033. I am handed 51 sealed envelopes with certified electoral votes in them -- one for each state, plus the District of Columbia.

Under what authority do I reject any of them?

14th Amendment claimee non-NBC Marco Rubio, born in the U.S. of two non-citizens, is currently being chatted up by Ryan Gurduski on the Clay and Buck show as being on the Trump VP short list.

Why does this falsehood keep being repeated?

He was born in the United States to parents legally within the United States. He is a Natural Born Citizen. Period. This is what the phrase meant at the time it was written into the Constitution. If the Framers wanted the phrase to mean something other than what it meant at the time they wrote it, they would have spelled that out. And not only that - it has been adjudicated multiple times.

And Rubio cannot be the VP anymore than DeSantis - unless Trump or one of them leaves Florida - we cannot give up 30 Electoral Votes off the bat and expect to win the election.
