Senate negotiators unveil long-sought border deal

The deal includes provisions to raise standards for asylum screening and to process claims faster, ends the practice known as “catch and release,” and provides a new authority to close the border when crossings reach a set threshold.

The full supplemental — which includes funds for the border, Israel and Ukraine aid, and other foreign policy priorities — totals $118 billion, with about $20 billion going to the border component.

Lankford called it “a once-in-a-generation opportunity to close our open border and give future administrations the effective tools they need to stop the border chaos and protect our nation.”

The deal is to solve illegals (which it won’t) by processing hundreds of thousands of them legally.

The government would never ever allow an end to catch and release, since the only way it could work is with very large detention centers/refugee camps that would IMMEDIATELY cause lawsuits with the result of court-ordered release.

Our present system of government cannot stop the invasion.

governments supposedly cannot tighten laws on political asylum, because those are regulated by the 1951 United Nations Convention on Refugees. This means that virtually every economic migrant picked up in a smuggler boat off the Italian coast (or in one of the rescue boats sent by progressive foundations to ply the waters nearby) claims to be a victim of political persecution seeking asylum. This gives newcomers the right to a lengthy sojourn in Europe while awaiting an asylum hearing. Nowadays most such claims are rejected, but it is expensive and bureaucratically difficult to ship the applicants back to where they came from. The denied applicant is simply dismissed with a written notice that he is required to leave French territory (obligé de quitter le territoire français, or OQTF). He almost never does. Macron’s bill would, among other things, end this charade by restoring the criminal offense of illegally staying in the country, a measure that 82% of French citizens back.

The Macron bill is not particularly robust. It contains a giant loophole inserted at the behest of corporations—permitting the hiring of undocumented migrants for “occupations under pressure.” This may wind up undoing everything the bill achieves.

Article 23 - Public relief

The Contracting States shall accord to refugees lawfully staying in their territory the same treatment with respect to public relief and assistance as is accorded to their nationals.

Article 17 - Wage-earning employment
....
2. In any case, restrictive measures imposed on aliens or the employment of aliens for the protection of the national labour market shall not be applied to a refugee...who fulfils one of the following conditions:
(a) He has completed three years’ residence in the country;
....
(c) He has one or more children possessing the nationality of the country of residence.

Article 34 - Naturalization [and getting the right to vote (and buy AR-15s)]

The Contracting States shall as far as possible facilitate the assimilation and naturalization of refugees. They shall in particular make every effort to expedite naturalization proceedings and to reduce as far as possible the charges and costs of such proceedings.

Article 44 - Denunciation [getting out from under the Refugee Convention]
1. Any Contracting State may denounce this Convention at any time by a notification addressed to the Secretary-General of the United Nations.
2. Such denunciation shall take effect for the Contracting State concerned one year from the date upon which it is received by the Secretary-General of the United Nations....

NOTE: I do not trust any politician who has not called for invoking Article 44 to get the US out from under the Refugee Convention.

And my distrust extends to Trump and DeSantis.

The Refugee Convention must be removed from the Democratic Party toolbox by invoking Article 44.

Just like the Senate scum to release their 300+ page monstrosity on a Sunday night, then schedule a vote in a day or two. What an enormous betrayal of the American people. I hope Sen. Lankford is voted out the next time he runs.

The unipartys answer to Trump’s poll numbers is to pretend like Trump is the reason the border is open. It was opned without a bill and can be closed without a bill. Johnson is going to cave because that’s what he does and this problem will remain a problem.

Asylum seekers at out southern border are in Mexico.

What is Mexico doing to them that qualifies them for asylum?

If Mexico is persecuting them, than I’d propose bombing Mexico until they stop violating the human rights of these people.

Article 31. - Refugees unlawfully in the country of refuge

1. The Contracting States shall not impose penalties, on account of their illegal entry or presence, on refugees who, coming directly from a territory where their life or freedom was threatened in the sense of article 1, enter or are present in their territory without authorization, provided they present themselves without delay to the authorities and show good cause for their illegal entry or presence.
2. The Contracting States shall not apply to the movements of such refugees restrictions other than those which are necessary and such restrictions shall only be applied until their status in the country is regularized or they obtain admission into another country. The Contracting States shall allow such refugees a reasonable period and all the necessary facilities to obtain admission into another country.

Article 32. - Expulsion

1. The Contracting States shall not expel a refugee lawfully in their territory save on grounds of national security or public order.
2. The expulsion of such a refugee shall be only in pursuance of a decision reached in accordance with due process of law. Except where compelling reasons of national security otherwise require, the refugee shall be allowed to submit evidence to clear himself, and to appeal to and be represented for the purpose before competent authority or a person or persons specially designated by the competent authority.
3. The Contracting States shall allow such a refugee a reasonable period within which to seek legal admission into another country. The Contracting States reserve the right to apply during that period such internal measures as they may deem necessary.

The Refugee Convention by permitting illegal entry (and entry upon any request) makes it impossible to secure the border. We need to get out from under the Refugee Convention.
