The constitutionality of a presidential pardon when there has been no prior conviction has never been tested by the USSC. It is constitutionally dubious, exactly like the demonrats pushing the 14th amendment on Trump when there has been no finding, much less a conviction, for insurrection. Or even the BS NY civil case where the state is charging multiple frauds but does not have to prove it or show prior convictions or liability for any past fraud.
