IL:Maintenance man, gunman shot after victim fights back during attempted robbery in Waukegan

A maintenance man was shot during an attempted robbery and fought back against the gunman, resulting in the suspect being shot with his own gun, in Waukegan Tuesday.

The Waukegan Police Department and Waukegan Fire Department responded around 10:45 a.m. Tuesday to Beechwood at the Preserve Apartments in the 3000 block of 8th Street for a report of a shooting.

Officers arrived and learned two people had sustained gunshot wounds.

A 17-year-old boy was found in an apartment with a gunshot wound to his thigh, according to a police report.

An officer applied a tourniquet to the boy’s leg before paramedics arrived.

The second person, a 20-year-old man working maintenance for the apartment building, was found with a gunshot wound to his thigh, the report said.

He was found on the ground by a dumpster behind the apartment building.

An officer provided first aid to the victim before paramedics arrived.

The 20-year-old man told officers that the 17-year-old boy attempted to rob him with a pistol and he fought back, the report said.

I realize this is tongue in cheek. Having read up on the topic I realize that in most cases if you use a gun, however legitimate the use is, you’ll lose the gun. Thus, I carry an inexpensive yet reliable gun. The guys who carry a $1500 gun are the types who wear jewelry. It’s for display, not practicality.

I bet the 20 yo is in for a surprise. If you take the pistol away from the attacker then there is no longer a lethal threat, no justification to shoot. However, if in the process of disarming, the pistol fired and bullet hit the bad guy then he might come out alright.

Poor maintenance man will probably be sued or put in prison or both for having the gall to defend himself.

17 y.o. found in an apartment... Odd. Whose apartment? Did he break in after his failed robbery? Someone let him in? Was it “where he be stayin”?

Sounds like he sallied forth from his dwelling to rob/shoot the maintenance guy for his own complex, then limped back home. A criminal mastermind at work. Trayvon, is that you?

At 17, is he legally allowed to purchase or own a gun (handgun, I assume).

Probably not his own, but stolen.

Objectively, the attacker could attempt to recover his lost gun and has already demonstrated a lethal threat in the initial attack. If the victim is already wounded from the previous attack, the threshold for "lethal threat" goes way down. Only an explicit surrender from the attacker establishes the end of a lethal threat. Or the attacker can back away, unarmed, to establish the end of a lethal threat.

What the attacker cannot do, is stand there bleeding and swearing at the victim or advance on the victim in any way. That does not end the original threat. The attacker must (1) Withdraw from the fight and (2) Effectively communicate that withdrawal to the other person.

This is a minimal the "Standard of Reasonableness" in all States. See "The Law of Self Defense" by Andrew Banca. pp 49 (Withdrawal/Communication).

But laws do not matter as much as they should. In practice the treatment of the case depends on the jurisdiction and the political views of the District Attorney. It also depends on the race of the attacker and victim. Under the current pretense of law, a black attacker may well have charges dropped if a white victim counterattacks. And the white victim may be charged with a crime for resisting.
