CO SecState Griswold: ‘Real Questions’ if the Constitution Disqualifies Trump from Presidency

Colorado Secretary of State Jena Griswold (D) Monday on CNN’s”News Central” that there were “real questions” about whether the Constitution disqualified former President Donald Trump from running for president or being seated in the office.

Anchor John Berman said, “In Denver, court proceedings under way and you are are looking at live picture right now to see if section 3 of the 14th Amendment should keep Donald Trump off of the presidential ballot. Let me read it, ‘No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any state, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any state legislature, or as an executive or judicial officer of any state, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.'”

Griswold said, “Yes, that is right. With this court case, we are hoping that it is giving guidance to ballots across the nation. We have never had this type of situation occur where a sitting president incites the insurrection and then had the audacity to run again. So there are real questions of Section 3 of the 14th Amendment disqualifies him. I am looking forward to the judge giving guidance on the topic.”

She continued, “I will follow whatever court determination is in place by the time I certify the ballot. I do believe that Donald Trump incited the insurrection.”

Griswold added, “So did his actions rise to the level of disqualification, and who gets to determine that? Is it me, The court?

Hey Jena. Maybe you should try to charge him with “insurrection” first before trying to remove him. Maybe read section 5 after you read section 3 for how and who can remedy (hint, it is not you).

It was always going blue. Arizona is next. As libtard Kalifornians move from a state that taxes everything; they realize they have twice the purchasing power within these states. Nothing Bush nor Cheney could have done would have prevented that trajectory.

Of course, there never was an insurrection, it’s all a farce, at this point whatever the Democrats call it is insignificant, what’s important is potentially removing Trump from the ballot.

The Supreme Court of the USA will be the ultimate judge on this case, the sooner the better in terms on ruling on it.

if this case is successful, then it’s all over the Republicans becoming POTUS.

1. 14th specifies “elector of”, not simply President (and Vice President).
2. 14th does not negate the original Constitutional qualifications, which it must do to set aside those qualifications. Since it does not alter the qualifications of the those attempting to be \elected\, the originals must be considered as primary.

This entire case can only be considered valid within a Progressive vacuum.

If he incited an insurrection, he sure wasn’t very good at the strategy part. Telling people to demonstrate peacefully, not telling them to bring weapons.

Oh, and he only asked if the House needed the National Guard for additional security instead of sending them over to dispatch Pelosi’s police. In fact, as CiC, he totally forgot to send any of the other military branches, which is normally what a rebel with such power would do.

He was a decidedly better president than leader of an insurrection that never was.

I guess the question is can you lead an insurrection against yourself? They seem to forget that Trump was still the lawful elected head of the US Government when the so-celled “insurrection” against the US Government occurred. They might have a better case if all this had happened a week after Biden was sworn in, but to call what happened an insurrection is laughable.

The 14th Amendment talks about “insurrection” and “rebellion”. Neither was declared by Congress (or anyone else) by Jan. 6, 2021. Therefore, there was no insurrection or rebellion. And the 14A does not apply.

But here’s one thing that does apply. The Constitution prohibits ‘ex post facto’ laws (laws meant to retroactively punish). And that’s exactly what the Democrats are trying to do here. They have decided to declare an insurrection for something that was not an insurrection on Jan. 6.
