National Association for Gun Rights Sues Gov. Lujan Grisham Over Carry Ban

The National Association for Gun Rights (NAGR) and Foster Haines (NAGR member and Albuquerque resident) filed a lawsuit against Governor Michelle Lujan Grisham and Secretary of Health Patrick Allen for Executive Order 2023-130 and a subsequent Public Health Emergency Order issued by the Secretary, which bans the public carry of firearms in Albuquerque for 30 days.

Plaintiffs are asking for a Temporary Restraining Order and a repeal of the Order.

NAGR argues the Order is unconstitutional on the merits of the Supreme Court’s ruling NYSRPA v. Bruen, which held New York’s ban on the public carry of firearms unconstitutional. Bruen also held that any gun regulation that does not fall into the text, history, and tradition of the Second Amendment is unconstitutional.

“Gov. Luhan Grisham is throwing up a middle finger to the Constitution and the Supreme Court,” said Dudley Brown, President of the National Association for Gun Rights. “Her Executive Order is in blatant disregard for Bruen. She needs to be held accountable for stripping the God-given rights of millions away with the stroke of a pen.”

Gov. Luhan Grisham declared a state of emergency over “gun violence” and used emergency powers to carry out the ban.

“This is the very danger of runaway executives who believe they have unilateral authority to suspend the Constitution under the guise of an ‘emergency,’” continued Brown. “This is exactly what we warned about during COVID. It’s a tale as old as time, give emergency powers, lose fundamental rights. Google ‘Caesar’ if you want to know how that turns out.”

The National Association for Gun Rights argues Gov. Lujan Grisham overstepped her Constitutional authority in issuing Executive Order 2023-130 and looks forward to its day in court.

I want to know will the FBI raid her office and house, will the DOJ convene a grand jury, Will the states AG investigate, Will the Albuquerque DA convene A Grand Jury? When will she be arrested? Those are my questions!

Yep! Not,sure what they did when ny violated the co situation with their “safe act”- I see they still have the act despite it not doing a thing to reduce crime like they falsely claimed it would. They too passed it under the guise of “emergency” too. Still stands as far as I know.

And recently hochul vio,ated the co situation and got slapped down by the sc, but that didn’t stop her- she went right ahead with more violations, trying to ban guns in public places- she just keeps rewording the new laws to skirt the sc orders.

Maybe they realize such an overreach might get new court ruling wiping away all local and state infringements against the second amendment. One of these days, it’s going to happen and actions like Lujan make it sooner than later.

So all those women who have conceal carry due to court orders must now rely on the police who are 10 minutes away to save them when their attackers are knocking down the door.

Her order has nothing to do with home self defense. Only carrying in public which the criminals won’t obey. Wonder ful logic all Dems have. Not.

I’ve been thinking about her motivation for doing this. I think this is basically a trial balloon for all the leftist Democrat run cities.

There’s no real practical reason for doing it otherwise. What happens at the end of 30 days when crime doesn’t magically go away in Albuquerque? An extension? And then another extension? And then when it’s not stopped it becomes indefinite, followed up by happening in Chicago New York and the rest of the Communist cities.

This flood of emergency Powers is the death of what is left of a republic based on law
