I don’t think that even a NYC jury will convict Daniel Penny. But it certainly is an outrage that he is being put through this experience.

People wonder why no one acts to stop crime on the streets or the subway.
Some of the best criminal defense has been done by public defenders, usually the lowest of attorney pecking order, yet they’ve been good at picking a procedural error and exploiting it.

But I’m also aware that this is NYC in the deep blue state of New York which also changed laws last year so Trump could be retroactively indicted for things that weren’t a crime before.
There’s only one way to reconcile this…
