Where public servant fail to perform their duties, yes.
I can see arguments for and against qualified immunity. Personally, I believe that QI should not be automatically applied but should have to be determined by a jury first - so that the community so affected is responsible for determining whether an officer should receive QI for his actions or not, with ‘not’ being the default. This should not be determined by a judge or DA but by the citizens.
