Sounds to me like this was Joey the Blackmailer’s burner phone and if Hunter the Crackhead hadn’t lost his laptop no one would have ever known about it.

If so, he’s not even a competent criminal. The whole point of a burner phone is to use up the pre-paid minutes and then get rid of it. He didn’t get rid of it, just had Hunter pay for it! This is the Gang Who Couldn’t Shoot Straight.
I don’t think the article is saying he still has the phone. The subpoena is to get its records from the cell provider. It doesn’t matter if the phone still exists or not.
