Manhattan District Attorney Alvin Bragg plans to bring manslaughter charges against former Marine Daniel Penny after he saved lives and protected fellow New Yorkers from a violent, longtime criminal on the subway.
"The 24-year-old former Marine seen on video gripping the neck of Jordan Neely, who died of the chokehold on the floor of an F train in Manhattan this month, is expected to be charged and surrender as early as Friday, three sources familiar with the matter tell News 4 New York," NBC 4 New York reports."[The] decision to charge Daniel Penny was made by the Manhattan District Attorney's Office – and will happen without being presented to a grand jury at this time."

I dispise Bragg, but he correct to charge in this case. Under NY law, a person can only use deadly force to prevent death or serious bodily harm to himself or another person. By all accounts, Neely (the dead guy), was ranting and raving, and acting in a “hostile and erratic” manner, yelling that he was hungry and thirsty, that he would hurt anyone on the train, and that he didn’t “mind going to jail or getting life in prison,” adding “I’m ready to die.” But he never displayed a weapon, physically attacked or attempted to physically attack anyone. Penny (the ex marine) held Neely in choke-hold for 15 minutes, even though Neely had lost consciousness. While I don’t think. Penny intended to kill Neely, I do think there are grounds to charge criminally negligent homocide.

The carotid hold, it’s not deadly force. It is used to subdue. All force has the potential to be deadly, that’s why they changed the term “non-lethal” to less-lethal.
Of course not. That’s for Bragg to prove beyond a reasonable doubt and a jury to decide. What i am saying is there is enough evidence to charge Penny with criminal negligent homocide.
Agreed, but the issues are why was it necessary in the first place in response to verbal threats; and why did penny continue the hold after Neely was unconscious and crapped his pants.
Maybe they should not be so confident.

I am reminded of Winston Churchill’s prophetic words: “If you will not fight for the right when you can easily win without bloodshed; if you will not fight when your victory will be sure and not too costly, you may come to the moment when you will have to fight with all the odds against you and only a precarious chance for survival. There may even be a worse case. You may have to fight when there is no hope of victory, because it is better to perish than to live as slaves.”

Maybe an unpopular opinion around here. But anyone who has done martial arts knows how dangerous the move is. When used during sparring, the person who has this applied to “taps out” to signal to stop. Or there is a referee or instructor there to intervene if the guy is put to sleep before tapping.
