Had he been convicted he'd have been barred from having guns as a convicted felon, a situation the pro-gun side accepts and the anti-gun side claims would have rendered him incapable of doing this. So if the past allegations were true, unless he was charged, tried and acquitted the question becomes which enabling, weak on crime, prosecutor left him capable.

That would most likely be Michael J. Allen, the District Attorney for Colorado's 4th District that oversees El Paso County.
