TALLAHASSEE — Calling the state’s approach “positively dystopian,” a federal judge on Thursday blocked a law championed by Gov. Ron DeSantis that restricts the way race-related concepts can be taught in universities.
The law is “antithetical to academic freedom and has cast a leaden pall of orthodoxy over Florida’s state universities,” Chief U.S. District Judge Mark Walker wrote in the 139-page ruling.
“Neither the state of Florida’s authority to regulate public school curriculum, nor its interest in preventing race or sex discrimination can support its weight. Nor does the First Amendment tolerate it,” he added.
DeSantis’ administration quickly said it will appeal the ruling.
The law, which DeSantis dubbed the “Stop Wrongs To Our Kids and Employees Act,” or “Stop WOKE Act,” lists a series of race-related concepts and says it would constitute discrimination if students are subjected to instruction that “espouses, promotes, advances, inculcates or compels” them to believe the concepts. The Republican-controlled Legislature passed the law this year.
Faculty members who violate the law, which has sparked several legal challenges, could be fired, and a “substantiated violation” of the restrictions would make schools ineligible for what is known as performance funding.
Walker’s ruling, which granted a preliminary injunction against the law, came in two lawsuits filed by professors and students from several state universities. The plaintiffs argued that the restrictions are causing confusion for instructors, are having a chilling effect on speech inside classrooms and are an unconstitutional infringement of professors’ First Amendment rights.

The state of Florida determined that it does not want its EMPLOYEES to "indoctrinate" students in Marxist ideology. The Obama judge determines that the state MUST allow and PAY for this Marxist ideology to be taught.
This is an Employer/Employee relationship. It only applies to State Schools.
DeSantis has the right the same as Elon Musk has a right.

Oh, no, Judge! We can't be casting leaden palls! That hurts little wokey feelers! That's community College 1-L level dissertation, right there.
Not to do what DeSantis proposes is to leave the professoriate with a demonstrated tighter indoctrinating (now WOKE) grip over students—in opposition to parents’ interests, whose who are generally the ones footing their children’s university bills.
For the state and parents—those footing the vast majority of state schools’ expenses—to find traction in expressing their interests alongside the schools’ influence is only right.
As I read this, the restriction only applies to university-level education, leaving elementary and secondary education restrictions in place. I think indoctrination in the earlier years/grades is far more important to prevent. By the time a student reaches university, they are of an age to exercise their own judgment.
Requiring schools to teach students factual information is unconstitutional.
This judge needs some remedial courses in law and the constitution.
Another judge bought and paid for.
DeSantis needs to pull EVERY state DOLLAR from those schools.
Hillsdale College is working on nation wide Charter Schools.
